RICHARD ACWORTH

Will  - November23, 1798 - Somerset County, Md.

In the name of God Amen I Richard Acworth of Somerset County and State of 
Maryland being sick in body but of sound and perfect mind and memory blessed by 
Almighty God for the same, do make and publish this my last Will and Testament 
in manner and form following:
That is to say First I give and bequeath to my son John Acworth five shillings 
and no more of my Estate. I do also give and bequeath to my daughter Elizabeth 
Carmichael one negro man called Abraham during her natural life and after he(r) 
decease to Polly Carmichael and her heirs and likewise forty seven pounds ten 
shillings due me from John Carmichael deceased. I also give and bequeath to my 
daughter Elizabeth Carmichael one shilling more besides the above mentioned and 
no more of my estate.
I give and bequeath to my son Richard Acworth all my Rights of a track of land 
called Acworth's Old Age and also a piece of land that I leave William 
Hodgs(borne)? for (?) and also all my rights of lands lying on Barren Creek in 
Somerset County and State of Maryland to him and his heirs, but if he should die 
without a lawfiill begonon heir of his body then the above lands mentioned I 
give to my son James Acworth to him and his heirs.
I also give and bequeath to my son James Acworth on negro girl called Rhoda to 
him and his heirs. The above mentioned Richard Acworth and James Acworth is to 
receive their legacie at the age of nineteen years and after all my lawfiill and 
just debts is paid then the remainder of my Estate I give and bequeath to my 
four youngest children to be equally divided between them, Sally Acworth and 
Kitty Acworth and Richard Acworth and James Acworth, I do hereby appoint and 
make my beloved friend Edward Tull hole and sole Executor of this my last Will 
and Testament, and do give free liberty and power to said Edward Tull to cut any 
kind of timber on the land above mentioned for the support of my Children or to 
pay any Just claim that should come against the Estate above mentioned in 
witness whereof I the said Richard Acworth have here unto put my hand and seal 
this the twenty third day of November in the year of our Lord one thousand 
seventeen hundred and ninety eight. Richard Acworth (his mark X)

December the 31st, 1798 - Then came Edward Tull and made oath on the holy 
Evangelist of Almighty God that the within Instrument of Writing is the true and 
whole last Will and Testament of Richard Acworth late of Somerset county 
Deceased, that has come to his hands or posession and that he doth not know of 
any other.
Before James Bayly Register of Wills Recorded in Liber EB No. 17 folio #696, 
697, & 698

December the 31st day 1798 Then came John Sterling, Brittingham Tull and 
Clemincy Gillys three of the subscribing witnesses to the within last Will and 
Testament of Richard Acworth late of Somerset county deceased and personally 
made oath on the holy Evangelist of Almighty god, that they did see the Testator 
within named sign and seal this Will. That they heard him publish pronounce & 
declare the same to be his last Will and Testament & at the time of his so doing 
he was to the best of each of their apprehensions
of sound and disposing mind memory and understanding & that they did 
respectively submit their names as witnesses to the same in the presence and at 
the request of the Testator & in the presence of each other,
