Abell Signed: April 13, 1859 Proved: August 13, 1860 Last Will & Testament Of Elizabeth A. Abell In the name of God Amen. I Elizabeth A. Abell of St. Mary's County in the State of Maryland being of Sound and disposing mind memory and understanding, so make and publish this my last will and testament in manner and form following that is to say. ~~ Item. I give and bequeath to my daughter Susanna E. Wise my negro man Henry, Woman Mary and her Child Charlotte, also my set of dining tables; to her the said Susanna E. Wise and her heirs forever. Item, I give and bequeath to my daughter Jane A. Clements my negroes Gusty and Rachael to her and her heirs forever, but if the said Jane A. Clements should die without issue of her body born in lawful wedlock, then and in that case I desire that the property hereby bequeathed to her shall be equally divided between my other heirs at law then living. Item. I give and bequeath to my son Bennet R. Abell my house & lot in Leonard Town in fee simple: provided that he pay to my grand son Bennet Bloys King, the sum of one thousand dollars, when he arrives at lawful age, the interest to be annually expended by my said son Bennet R. in the education of my said grand son: if said Bennet B. King should die at any time without lawful issue, then the said one thousand dollars shall be equally divided between my other heirs at law then living. Item, I give my Piane to my grand daughter Martha G. Wise. The rest and residue of my estate I devise to my Executor hereafter named. (out of which my debts are to be paid) in lieu of commission on my estate for the settlement thereof. My silver plate I devise to Bennet R. Abell also negro Stephen. I hereby direct my Executor to pay to pastor of St. Aloys. Church at the time of my death the sum of twenty dollar. And lastly I do hereby constitute & appoint my son Bennet R. Abell sole Executor of this my last will and testament revoking all former wills by me heretofore made ratifying and confirming this and none other to be my last Will and Testament. Abell late of St. Mary's County deceased, being this day during the recess of the Orphan's Court presented to me for probat, and Bennet R. Abell being present and assenting to the same, and no objection being made or caveat filed against the said last Will & Testament, I, James L. M. Abell late of Saint Mary's County deceased and severally made oath on the Holy Evangels of Almighty God that they did see the Testatrix therein named, sign, seal this will and that they heard her publish pronounce and declare the same to be her last Will and Testament, that at the time of her sodoing she was to the best of their apprehensions of sound and disposing mind, memory, & understanding, and that they respectively subscribed their names as witnesses to this will in the presence and at the request of the said testatrix and in the presence of each other.
