I Mary Drury of Saint Mary's County being in feeble health of body but of sound and disposing mind, memory and understanding considering the certainty of Death and the uncertainty of the time thereof and being desirous to settle my worldly affairs and thereby be the better prepared to leave this World when it shall please God to call Me home, do therefore make and publish this my last Will and Testament in the manner and form following that is to say: First and principally I commit my soul into the hands of Almighty God, and my body to the Earth to be decently buried at the discretion of my Executor to be hereinafter named. ~~ Item, I give and bequeath to my grand son Edgar Combs, son of John C. Combs eight hundred dollars with the interest thereon from my death to him and his heirs forever. ~~~ Item, I give and bequeath to my grand-daughter Mary Drury Combs, daughter of John C. Combs my negro girl Eliza and her future increase and profits to her and her heirs forever. ~~I also give and bequeath to the said Mary Drury Combs one bed and furniture and five shares of Stock in the Saint Mary's Saving's Institution to her and her heirs forever. But in the event of the death of either of My said grand children before they arrive at lawful age, then the property hereby bequeathed to the one so dying shall go to the survivor, and if both my said grand children should die before they arrive at lawful age, then I desire that the property hereby devised to them shall be equally divided among my heirs at law. It is my will and desire that my son William H. Drury shall have the care and management of the property herein before bequeathed to my aforesaid grand children Edgar Combs and Mary Drury Combs until they arrive at lawful age then my son William H. Drury shall pay over to my said grand children respectively the property herein before bequeathed to them. Item, I give, devise and bequeath all the rest and residue of my Estate to my son William H. Drury and my daughter Mary Ann Drury to them and their heirs forever to be equally divided between them share and share alike. And Lastly, I do hereby constitute and appoint My son William H. Drury sole Executor of this my last Will and Testament, revoking and annulling all former Wills by me heretofore made, ratifying and confirming this and none other to be my last Will and Testament. In testimony whereof I have hereunto set my hand and seal this twenty fifth day of January in the year of our Lord eighteen hundred and fifty-three. Spalding Saint Mary's County to wit, The 10th day of February 1863. ~~~ The last Will and Testament of Mary Drury late of St. Mary's County deceased, being this day presented to the Orphan's court of St. Mary's County for probat and no objection being made or caveat filed against the same, the Court admitted the said last Will & Testament of Mary Drury to probat, and I, James T. M Raley, Register of Wills for St. Mary's County proceed to take the probate accordingly ~~~~~ Certified by Jas. T. Loker, two of the three subscribing witnesses to the within last Will and Testament of Mary Drury late of Saint Mary's County deceased, and severally made oath on the Holy Evangels of Almighty God, that they did see the Testatrix therein named sign and seal this Will and that they heard her publish, pronounce and declare the same to be her last Will and Testament. That at the time of so doing she was to the best of their apprehensions of sound and disposing mind, memory, and understanding and that they respectively subscribed their names as witnesses to this Will in the presence and at the request of the Testatrix and in the presence of each other and also that they did see Lucretia Ford the other witness to this Will subscribe the same in the presence and at the request of the Testatrix.~~~ Certified by Young P. Dawkins} Judge of the Orphan's Court for St. Mary's County ~~~~ Saint Mary's County to wit, The 30th day of March 1863 ~~ Then came Lucretia Ford one of the three subscribing witnesses to the within last Will and Testament of Mary Drury late of Saint Mary's County deceased and made oath on the Holy Evangels of Almighty God that she did see the Testatrix therein named sign and seal this Will and that she heard her publish, pronounce and declare the same to be her last Will and Testament that at the time of so doing she was to the best of her apprehension of sound and disposing mind, memory and understanding and that she respectively subscribed her name as witness to this Will in the presence and at the request of the Testatrix and also that she did see Wm. A. Loker the other witness to this Will subscribe the same in the presence and at the request of the Testatrix. ~~ Certified by Jas. T. M. Raley, Regr of Wills for St. Mary's County~ Whereas since the execution of the foregoing Will I have been obliged to sell the negro girl Eliza therein bequeathed to my grand-daughter Mary Drury Combs I do hereby in lieu of said negro girl, give and bequeath to the said Mary Drury Combs, the sum of nine hundred dollars with interest thereon from the time of my death ~~ In testimony whereof I have hereunto set my hand and seal this 15th day of February in the year one thousand eight hundred and fifty-nine.
