WILL OF JAMES MORGAN ST MARY'S CO. MD 22 January 1814 352. James Morgan's Last Will and Testament. In the name of God, Amen. I James Morgan of Saint Mary's Co and state of Maryland being sick and weak in body but of sound and disposing mind, memory, and understanding, considering the certainty of Death, and the uncertainty of the time: thereof: and being desirous to settle my worldly affairs, and thereby be the better prepared to leave this world when it shall please God to call me home, do therefore, make and publish this my last will and testament in mannerand form following,that is to say first and principally I commit my soul into the hands of Almighty God and my body to the earth to be decently buried at the direction of my Executor herein after named, and after my just debts are paid together with my funeral charges. I desire and bequeath as follows. Item. I give and bequeath unto my dear wife, Ann Morgan, the following property -?- of her dower in my whole estate, both real and personal to wit, one Negro woman called Rose, and one Negro boy called Mialu; also two horses her choice out of my stock of my horses not otherwise particularly bequeathed; also ten head of black cattle, among which to be included her share of a yoke of oxen, the rest to consist of cows, calves, heifers, steers or yearlings in proportion to there several kinds in my whole stock; likewise in ten herd of sheep; one sow and ten goats; her choice of my two ox carts two feather beds, with such furniture to the same as she may reasonably make choice out of the whole of my furniture; a pair of dining tables, a small square walnut table, -- /-- or chair, a --?-of my kitchen furniture and table equipage; Six hundred pounds of pork, twenty five barrels of corn and twenty bushels of wheat, such part there of as she may think -?- to be se-?_ by my Executor; and one walnut __?__ chest - all of the above property to be paid respectively paid out of my estate to her and her heirs for ever--- Item: I give and bequeath unto my son, William Morgan, my sideboard and small mahogany table. Item: I give and bequeath to my son George one half of the buildings used for Stales on the lot where on y Tavern now stands, to him and his heirs forever. Item: I give and bequeath to my son James Morgan my young horse colt which I bought of my son George Morgan, called __?__ Item: I give and bequeath to my daughter Elizabeth Morgan, one leather ---and furniture and other portion of my personal Estate not otherwise is particularly improper and bequeath, as she may elect to take, which together with the --?-and furniture shall be equal in value to Seventy Dollars, current money.- Item: I give and bequeath to my four children, that is to say, C---?---, Alexander, Ann and Emaline Morgan. One Negro boy, named Dennis, and two feather beds, and furniture to them and each of them jointly and equally. Item: I give and bequeath to Susanna Tippet the woman's saddle now called hers; and it is my desire and will that the Negro boy called Micah bequeathed as above shall become five=forty of the said Susanna at the decease of my said dear wife, Ann Morgan Item: I give and bequeath to Sophia Gardiner, now living with me, one feather bed and furniture. It is my wish that my said dear wife together with my Executor shall divide all my bed furniture, (except as given to her above, as near equal as the quality and quantity will even it between my feather beds. Also it is my will that as much wheat as shall be ----? ---- on the plantation wherein I now live shall be taken out of the crop either on hand or on the ground at the time of my death and seed on the said plantation or an ensuing crop by my Executor for his heirs and the use of my infant children above named-also, it is my wish that all my provisions either in the manor or of crops or the land at the time of my decease, (Excepting so much thereof as is above bequeathed to my said wife together with one killing as usual heretofore of hogs Shall remain in hands of my executor. And be applied to the use of my family-my crop or crops of wheat excepted whether on hand or on the land, and also that my rowboat, small canoe,--?-its appurtenances, shall be and remain in the hands of my executor for his use and the use and the use of such of my family as shall live with him. Item: I give and bequeath to my three Daughters, Elizabeth, Ann and Emaline Morgan, during their single lives a home in my dwelling plantation bequeathed to my son George as --?__, and it is my desire that they may live with him as of this family-and I further bequeath to them my --?-three daughters, together with my son Alexander, the use of my slave Jerry to assist in their support, and maintenance during the space of their years next after their decease, at the expiration of which terms I do hereby --?--et free --?-the said slave ,Jerry, forever - the trust -?- I place in the hands of my son George Morgan to be applied by him as aforesaid. Item: I give and bequeath to my to my two daughters, Susanna Mariaman (?) The said Elizabeth Morgan, and my said son George Morgan __?__, severally and equally all the rest Residence and remaining part of my Estate personal. What ever existing any crop or crops of wheat that shall be on hand at the time of my death, except --?__ thereof as is herein before bequeathed, and also my Tavern and also my Tavern and other buildings thereunto belonging (except half of the stables, as devised by my son George) together with the ground or lot on which the Tavern and other buildings now stand, beginning at the gate post standing near the roadn and running them southerly with fence on the east side of the road to my dwelling house till it --?-the race path-thence with the race path easterly until it forms a square by a line on the East drawn northward to the East end of the Stables ad to the main road, and thence with the said road to the first beginning, being one acre of land more or less, to them and their heirs --?-forever- Item: I give and bequeath to my said wife, Ann Morgan, two plows and the appliances for them, and it is my wish that the quantity of corn, and wheat as above bequeathed to then my wife, shall be taken out of any crops there of growing or to grow in the year in which my death shall appear- Lastly, I do hereby constitute and appoint my said son George Morgan sole Executor of this my last Will and Testament. In Testimony whereof I have hereunto set my hand and affixed my Seal this twenty second day of January in the year of our Lord one thousand eight hundred and fourteen. Then came George Morgan and made oath on the half of Almighty God that the within instrument of writing, together with an other instrument of writing __?__ to be a codicil, is the true and whole will and Testament of James Morgan late of Saint Mary's County deceased that hath come to his hand and possession, and that he doth a not know of any other. Certified by James Forrest, Reg. Of Will for and of St. Mary's Co. ( Witnesses made oath 26 day April 1814 that this was the will they witnessed.) James Morgan Codicil To his Last Will and Testament: Whereas I, I James Morgan of Saint Mary's County in the state of Maryland have made and duly Executed my last Will and Testament in writing bearing date: the twenty second day of January in the year of our Lord one thousand Eight hundred and fourteen, which said last will and testament and any source, bequest and device therein contained, I do hereby ratify and confirm (accepting so much thereof as is by --?_- __?__and made ready and being desirous to make some alteration, and addition thereto, do therefore hereby make this my codicil which I will and direct shall be taken and hereto as a Part of my said will and testament in manner and form following that is to say. I give and bequeath to my dear wife Ann Morgan my riding carriage with the Harness and gear and appurtenances thereto- I give and bequeath to my four youngest children to wit, Cornelius, Alexander, Ann and Emaline Morgan, eighty sheep to be equally divided among them and delivered to them in share as they shall arrive to age respectively, by executor named in my said will and testament, and after that my son, George Morgan (my said executor shall retain in his lands out of the residue mentioned in my said will, of my estate , three cows and calves, that is to say one cow and one calf to each of my said children Alexander, Ann and Emaline Morgan, paid by him at their __?__ time of age- and it is my will that my said son George shall be entitled to the remains if any of said cows and sheep that may accrue during the minority of my said four children-the use and profit of said cattle and sheep being intended as helping to support my said children in the care and guardianship of my said son George during the term of their minority-but that no __?__shall be sustained by my said children or either of them in case __?__shall be sustained by my said children or either of them in case any --?-shall happen as aforesaid- I give and bequeath to Susanna Tippet mentioned in my said last will A parcel of new feathers remaining in my house to make a bed or to be disposed of to her now as she shall see fit-I bequeath to my son George my yokes of black oxen (broke this spring) forever-all of the above article of bequest being part of the residue of my estate. Mentioned in my last will and Testament above said, are to be taken, and of the same- Signed sealed published and declared by James Morgan the above named Testator, as and for a codicil to his last will and Testament in the presence of us, who at his request in his presence and in the presence of each other he _?_ subscribed to our names as witnesses thereto, the eighteenth day of March and Domino eighteen hundred and fourteen.
