This Indenture made this seventeenth day of October in the year of our Lord eighteen hundred seven between Lancelot Jacques of Washington County in the state of Maryland of the one part, and John McPherson of Frederick Town and County in the said state of the other part witnesseth whereas by a decree of the Chancery court of the state aforesaid bearing date the first day of October eighteen hundred and six the above named Lancelot Jacques was appointed a trustee and authorized and empowered to sell and dispose of the estate conveyed in mortgage by Denton Jacques of Washington County to Thomas Johnson of Frederick County by deed of indenture bearing date the second of September in the year seventeen hundred seventy five, and afterwards conveyed and assigned by the said Thomas Johnson to the aforesaid John McPherson the complainant mentioned in the said decree by deed bearing date the sixth day of June in the year Eighteen hundred and six or to sell so much of the said estate as might be necessary for the payment of the several sums of money and to edies mentioned in the said decree and all costs arising on the said sale; and whereas in pursuance of the said decree and the directions therein contained the said Lancelot Jacques on the eighteenth day of December in the year eighteen hundred and six did proceed to make sale of the lands herein after mentioned being part of the mortgaged estate mentioned in the said decree and the same was sold to the said John McPherson the complainant aforesaid for the sum of thirty eight hundred and ninety pounds eight shillings and ten pence current money being the amount due to the said McPherson by virtue of the said decree which sale so as aforesaid made was by in order of the Chancery Court aforesaid dated the twenty seventh of March eighteen hundred and seven duly ratified and confirmed; and whereas the terms of sale have been fully complied with on the part of said John McPherson the purchaser aforesaid and the said Lancelot Jacques trustee as aforesaid is authorized and directed as well by virtue of the said decree as by force of a further order from the said Chancery Court bearing date the twenty fourth day of April in the year eighteen hundred and seven to convey to the said John McPherson the property of the lands is as aforesaid sold by a good and sufficient deed to be executed acknowledged and recorded agreeable to law; all of which will more fully and particularly appear by reference to the proceedings in Chancery wherein the said John McPherson was complainant, and Denton Jacques, Elie Williams and the said Lancelot Jacques where defendants: and the said Lancelot Jacques under the authority and in compliance with the directions Afore. Received the day and year within written and from the within named John McPherson the consideration within mentioned in the written Deed. Lancelot Jacques Witness A.B. Shriver Maryland to wit. Be it remembered that on this 17th day of October in the year of our Lord Eighteen hundred and Seven personally appears Lancelot Jacques party grantor mentioned in the within deed or instrument of writing before me the subscriber one of the Judges of the fifth Judicial District of the aforesaid State of Maryland and acknowledged the said deed written Instrument of writing to be his act and deed and the undivided moiety of the lands and premises therein maintained and thereby bargained and sold to be the right and estate of John McPherson party Grantee also therein mentioned his heirs and assigns forever according to the support true intent and meaning of the said deed or Instrument of writing and the act of assembly in such case made and provided. Acknowledged before and certified by A.B. Shrivey Hath agreed and is about to execute these presents. Now this Indenture witnesseth that the said Lancelot Jacques trustee as aforesaid in consideration of the above recited premises and also one dollar current money to him in hand paid the receipt whereof is hereby acknowledged hath given granted bargained and sold aliened released enfeoffed and confirmed and by these presents doth give grant bargain and sell alien release enfeoff and confirm unto the said John McPherson his heirs and assigns forever, one undivided moiety of part of two tracts of land being adjoining to each other in Washington County aforesaid that is to say all that undivided moiety of that part of a tract of land called Thythorn lying Eastward of a line drawn from the end of ten perches on the tenth line to the end of thirty-six perches on the twenty second line thereof containing one hundred and sixty-acres of land more or less. Whereof an undivided moiety is hereby conveyed and also that undivided moiety of all that part of a tract of land called Kindess Enlarged, that is contained by the following bounds and lines to wit. Beginning at the end of the tenth line thereof and running with the out lines of the same in succession to the end of the forty fifth line thence North eighty five degrees and half degrees West, sixty perches, then South twenty degrees West four hundred and twenty perches or till it intersects the main roads from Hagers Town to Cumberland and then with it North seventy five degrees West by forty perches, then South twenty degrees West two hundred And twenty-seven perches or to the end of the thirteenth line of the said land and reversing the same to the end point of the twenty ninth line and thence to the beginning. Containing fifteen hundred and eighty acres more or less whereof undivided moiety is hereby conveyed. Together with all and singular the rights and appurtenances there unto belonging. To have and to hold one undivided moiety of the aforesaid lands and premises with the appurtenances, unto the said John McPherson his heirs and assigns forever as tenant in common clear free and discharged from all claims of the said Denton Jacques and all other defendants mentioned in the aforesaid decree their and each of their heirs and assigns, and to and for no other use intent or purpose whatsoever. In Witness whereof the said Lancelot Jacques hath here unto set his hand and affixed his seal the day and year first above written.
