These electronic pages may NOT be reproduced in any format for profit or presentation by other organizations. ************************************************************************ Thomas Austin Will Washington County, MD Wills pp.528-530 Thomas Austin 25 March 1843 528 12 November 1840 In the name of God Amen I Thomas Austin of Washington County in State of Maryland being in perfect health of body and of sound and disposing mind memory and understanding considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence. Do therefore make and publish this my last will and Testament, in manner and form following that is to say. First and principally I commit my soul unto the hands of Almighty God and my body to the earth to be decently buried at the discretion of my Executors here in after named, and after my debts and funeral charges are paid I devise and bequeath as follows. Item. I devise and bequeath that all of my property both real and personal shall be sold and after my Executors shall have provided a head and foot stone to be placed on my grave with my name, age and with the following instruction “O! Death where is thy sting! O! Grave where is thy victory! The sting of death is sin and the strength of sin is the law. but thanks be to God where giveth us the victory through our Lord Jesus Christ. I further bequeath unto the heirs of my Son Thomas Austin to be equally divided share and share alike when the youngest heir shall became of age, one half of the proceeds of the sale of said property- -and I direct my Executors to place said fund an interest and to draw and appropriate such interest annually to the support and the education of the aforesaid heirs of my son Thomas Austin. Item. I devise and bequeath unto my son Joseph B. Austin the other one half of the proceeds of the sale of my aforesaid property both real and personal to him his heirs and assigns forever. Item. I give and bequeath to my Grand Daughter Mary Austin (daughter of my son Thomas Austin) one bedstead, bed and bedding which is excepted in aforesaid Sale. And lastly I do hereby constitute and appoint Samuel Mumma and my Son Joseph B. Austin to be sole Executors of this my last will and Testament revoking and anulling all my former Wills by me heretofore made ratifying and confirming this and none other to be my last will and Testament In testimony where of I have here unto set my hand and affixed my seal this 12th day of November in the year of our Lord one Thousand eight Hundred and Forty. signed’ sealed and published and declared by Thomas Austin the above name Testator and for his last will and Thomas Austin seal Testament in the presence of us who at his request in his presence and in the presence of each other have subscribed our names as witnesses thereto Jacob Rohrback David Funk James Allen Codicil to this my last Will and Testament Item- I give and bequeath to my Daughter in Law Louvenia Austin and wife of my son Thomas Austin Jr. The one half of the proceeds of my property both personal and real to have the whole and sole interest and management of the same during her natural lifetime revoking that Item included in the body of this my last Will devising the Same to the Heirs of my Son Thomas Austin. R. Ellsworth Cook David Funck 530 Washington County SS on this 25th of March 1843 came Joseph B. Austin and Samuel Mumma and made out the one that this is the true and whole Will and codicil of Thomas Austin Sen. Dec. and that do not know nor hath heard of any other At the same time came Jacob Rohrback and David Funck and severally made oath that they saw the above named Testator sign and seal this will that they heard him publish pronounce and declare the same to be his last will and Testament that at the time of his so doing he was to the best of their apprehensions of sound and deposing mind memory and understanding that they subscribed their names at his request in his presence and in the presence of each other and that they saw the other subscribing witnesses do the same.
