Jonathan Irvin, decd. || I, Jonathan Irvin of Washington county in the State of Maryland being in Perfect helth of Body and of sound and disposing mind and memory and understanding + considering the Certainty of death and the uncertainty of the time thereof and being Desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence, do therefore make and Publish this my last will and testament that is to say, First and principally I Commit my soul in the hands of Almighty God and my Body to the Earth to be decently buried at the Discretion of my Executor herein after named and after my debts and funeral charges are paid I Devise and bequeath as followeth — I Give and bequeath unto my beloved wife Easter Irvin all my real Estate and the Profits arising therefrom and all my Personal Property during her Life time or her Intermarige wich Shall first happen and after her Death or Intermarige I Give and bequeath unto my youngest son Allen Irvin all that tract of Land lying on the north side of the main Road leading from Hagerstown to Ohrs Gap Containing about thirty two acres of Land more or less and the said Allen Irvin is to pay one hundred dollars Current money as soon as he Get Possesion of said Land . on Intrest for said sum till paid and the rest of my Real and personal Property is to be sold and Equally Divided amongst my two sons Andrew Irvin and John Irvin and my Daughter Susana the three are to have Eaqual share alike and the notes and Judgment wich I hold against my son John Irvin and all money wich I have paid for him is to be reduckted out of the part of Leagacy so that their shall be a Equal Divedend amongs the three. and Lastly, I do hereby Constitute and appoint Michael Iseminger to be my sole Executor of this my last will and testament revoking and annulling all former wills by me heretofore made ratifying and Confirming this and none other to be my Last will and testament in Testimony whereof I have hereunto set my hand and affixed my seal this fourteenth day of November one Thousand Eight hundred and Twenty three. his Jonathan X Irvin [seal] mark Signed, sealed published and Declared by Jonathan Irvin, the above named testator, as and for his Last will and testament in the Presence of us who at his request in his Presence and in the Presence of Each other have subscribed our names as witness thereto —— Jacbbel Dubbel, Sam’l. Fahrney, Jacob Wolfkial (in German) (end of page 1 – beginning of page 2) Washington County, To wit: — On this 19th day of October 1824, came Michael Ise- minger and made oath that this is the true and whole will of Jonathan Irvin late of Washington County Deceased that has come to his hands and possession and that he does not know of any other. At the ame time came Jacob Dubbel and made oath that he did see the testator herein named sign and seal this will that he heard him publish, pronounce and declare the same to be his last will and testament; that at the time of his so doing, he was to the best of his apprehension of sound and desposing mind, memory and under- standing, that he subscribed his name as witness to this will in the presence and at the re- quest of the testator and that he saw the other subscribing witnesses do the same.
