I Andrew Irvin of of Andrew Irvin decd. || Washington county in the State of Maryland of ========================= sound and desposing mind memory and understan- ding Considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my worldly affairs and thereby be the better pre- pared to leave this world when it shall please God to call me hence do there- ‘fore make and publish this my last will and testament in manner and form following that is to say. First and principally I commit my Soul unto the hands of Almighty God, and my body to the earth to be decently buried and and after all my lawful debts and funeral ...: are paid I give and bequeath as follows to wit: I give and bequeath unto my dearly beloved Wife Sarah Irwin all my household and Kitchen furniture as well as any other personal property I may own at my decease. and I also give and devise unto my said Wife Sarah Irwin ni fee simple all my right; title interest and claim in and to nine acres and eleven perches of land with the house I occupy as also one other house now occupied by my Son Joseph Irwin this being part of a tract of land purchased by my Father Jonathan Irwin from Joseph Emmert in the Year 1823 she to do and dispose of this as she thinks proper And Lastly I constitute and appoint Henry Martin to be my Executor of this my last will and testament In testimony whereof I have hereunto set my hand and affixed my Seal this 3rd day of July 1848 his Andrew X Irvin [seal] mark Signed sealed published and declared by Andrew Irwin the testator hereto, as and for his last will and testam- ent in the presence of us who at his request and in the presence of each other have subscribed our names as witnesses thereto John Newcomer. Richard Kennedy Maryland Washington County Sct: On the 17th day of October 1848 came John Newcomer one of the subscribing witnesses to the written will and made (end of page 1 – beginning of page 2) Oath on the Holy Evangely of Almighty God: and at the same time came Samuel Fahrney one of the subscribing witnesses to the within will and af- “firmed that they did see the Testator within named make his mark and seal this will: that they heard him publish pronounce and declare the same to be his last will and testament. That at the time of so doing he was to the best of their Apprehensions of sound and desposing mind memory And understanding, And that they together with the other subscribing witness subscribed their names as witnesses to this will: at the request And in the presence of the Testator, and in the presence of each other. Named in the within will + made oath on the Holy Evangely of Almighty God, that this is the true and whole will of Andrew Irwin late of Washing- ‘ton County decd. that has come to his sight or knowledge and that he does not know nor has he heard of any other.
