I desire and direct that my body be decently buried at the discretion of my ex- ecutor, hereinafter named, and after my debts and funeral charges are all paid, I give, be- queath and devise as follows:- Item. I give, bequeath and devise unto my beloved wife, Margaret Irvin, all of my es- tate, real and personal, of which I shall die seized and possessed, for and during her natur- al life, or so long as she remains my widow, and from and after the death or remarriage of my said wife, remainder to be distributed as hereinafter directed and provided. Item. It is my will that such portion of the personal estate as my said wife shall not need for housekeeping shall be sold by my executor and the proceeds therefrom be applied to 234 the payment of debts and funeral expenses, the sale of such personalty to be made as soon af- ter my death as practicable. Item. On the death or remarriage of my said wife, Margaret Irvin, I direct that all the remainder of my estate shall be sold by my executor, and the proceeds thereof, after the pay- ment of the funeral and burial expenses of my said wife in the event of her death as my wid- ow, be distributed as follows: Item. I give and bequeath unto my grandson, William Reese, son of my daughter, Elizabeth Reese, the sum of Fifty dollars, the same to be to him, the said William Reese absolutely. Item. I give and bequeath unto my grand-daughter, Leafie Reese, daughter of said Eliza- beth Reese, the sum of Fifty dollars, the same to be to her the said Leafie Reese, absolutely Item. I give and bequeath unto my grandson, Howard Ridenour, son of my deceased daughter, Susana Kate Ridenour, the sum of Fifty dollars the same to be to him, the said Howard Ride- nour, absolutely. Item. All the rest and residue to be divided into three equal shares and distributed as follows: one share to my son, William Irvin; one share to my daughter, Elizabeth Reese; and one share in equal portions to the children of my deceased daughter, Susana Kate Ridenour. Lastly, I do hereby constitute and appoint McClellan Stouffer, of Washington County, State of Maryland, to be executor of this my last will and testament; and do hereby vest my said executor with full power of sale and all other powers necessary to effect the provisions of this my will. Also hereby cancelling, revoking and annulling all former wills by me here- tofore made, and ratifying and confirming this and none other to be my lost will and testa- ment. Stover Signed, sealed, published and declared by Joseph Irvin, the above named testator, as and for his last will and testament in our presence, who, at his request, in his presence, and in the presence of each other have subscribed our names as witnesses hereto; and we believe that the above named testator is fully competent to make a valid deed or contract. D, 1916, came McClellan Stouffer, Executor named in the will of Joseph Irvin, late of Washington County, deceased, and made oath in due form of law, that the aforegoing is the true and whole Will of said deceased, that has come to his hands and possession, and that he does not know nor has he heard of any other. Sworn before, Thos. E. Billiard, Register of Wills of Washington County, Md. State of Maryland, Washington County, to-wit: On the 19th day of September, 1916 came Daniel E. Kinsey and George M. Stover, the sub- scribing witnesses to the aforegoing last Will and Testament of Joseph Irvin, late of Wash- ington County, deceased, and made oath in due form of law, that they did see the Testator sign and seal said will; that they heard him publish, pronounce and declare the same to be his last Will and Testament, and that at the time of his so doing, he was, to the best of 235 their apprehensions, of sound and disposing mind, memory and understanding; and that they subscribed their names, as witnesses, to said Will, at his request, in his presence and in the presence of each other. Sworn in open court. Test: Thos. E. Hilliard, Register of Wills of Washington County, Md. In the Matter of the Probate of a Paper Writing, Purporting to be the last Will and Tes- tament of Joseph Irvin, deceased. The Court having heard the testimony of Daniel E. Kinsey and George M, Stover, the sub- scribing witnesses to the said Paper Writing purporting as aforesaid: Doth thereupon order, adjudge and decree, this 19th day of September, A. D. 1916, that said Paper Writing be and the same is hereby admitted to probate as the last Will and Testament of Joseph Irvin, late of Washington County, deceased, Wm. H. A. Hamilton- Geo. H. Young John. B, Huyett, Judges of the Orphans' Court of Washington County.
