I Martin Lyon of Washington County and State of Maryland being in perfect health and disposing mind memory and understanding, considering the certainty of death, and being desirous to settle my worldly affairs, and thereby be the better prepared to leave this world when it shall please God to call me hence, do therefore make and publish this my Last Will and Testament in manner and form following-that is to say-first and principally I recommend my soul into the hands of Almighty God - my Body to be buryed in a Christian like manner at the discretion of my Executors hereafter named - and touching my worldly Estate I dispose of the same in manner and form following viz: First - that all my just debts and funeral charges be paid by Executors - Secondly it is my will and desire that my beloved Wife Catharine shall have during her natural life, and not to be accountable for, in Lieu and in full of her thirds of my whole Estate, the dwelling house which we now live in, and as much of the Garden as she may want for her own use - all my householdand kitchen furniture and Utensils - one riding Mare, Saddle and Bridle, and one Cow, which Mare and Cow my son George shall find Feed and Stablage for during her natural life, and my son George shall further furnish and give unto my Wife his mother, yearly, and every year, without cost or charge during her natural life Four pounds current money, Ten bushels of wheat, six bushels of Rye, four bushells of Corn, one Fatt Hogg, or one hundred and forty pounds of Pork, Thirty poundsof Beef, twelve pounds of Rackled Flax or hemp, Five pounds of Wool, one Bushel of Salt, and as many potatoes as she may require for her own use - Thirdly - It is my Will and desire that my Grand Daughter Mary Nichodemus have Ten pounds current money which shall be paid unto her by my Wife Catharine, as soon as my said Grand Daughter is married. Fourthly, it is my Will and desire that after the death of my Wife Catharine all the household and kitchen Furniture and Utensils and Stock, if any there be remaining, be equally divided among my three Daughters, viz: Elizabeth wife of Lodowick Kemp, Catharine wife of Vandle Clase, and Barbara Wife of Frederick Woolf - Fifthly, I give and bequeath unto my Son George Lyon, his heirs or assigns forever in fee Simple Two Hundred and Eight acres of Land being part of a Tract of Land called Fellfoot &c(sic), which he and myself now live on and occupies, The House and part of the Garden, for the use of my wife as above mentioned excepted during her life - Also one Wagon, one Wind Will - one Jack Screw, Two plows and one Iron Harrow provided my Son George complys strictly with the provisions of this my will as before - mentioned and that my son George his heirs or assigns do permit and allow his Brother Jacob Lyon his heirs or assigns to have and enjoy peaceable use three days and three nights in each week, of such part of a stream of water as runs through said George Lyon's land, as my son Jacob may require for watering his Land - And Lastly I do hereby constitute and appoint my two sons Jacob Lyon and Henry Lyon to be my sole Executors of this my Last Will and Testament, hereby revoking & annulling all former Wills by me made, ratifying and confirming this and none other to be my Last Will & Testament In testimony whereof I have hereto set my hand and seal this seventh day of March in the year of our Lord Eighteen hundred and Three Martin Lein (seal) (in German) Signed Sealed published and declared by me Martin Lyon - the above named Testator as and for my Last Will and Testament in the presence of us who at his request and in his presence have subscribed our names as Witnesses thereto in presence of each other - George Scott Senr. John Betebinner, Henry Heck (in German) Washington County to wit: On the 7th day of December 1804 came Jacob Lyon one of the Executors named in the within Will of Martin Lyon Decd. and made oath &c(sic) that the within instrument of writing is the true and whole will of the said Martin Lyon - that hath come to his hands and possession and that he doth not know of any other. At the same time came George Scott & Henry Heck two of the three subscribing witnesses to the within last Will and Testament of Martin Lyon decd. and made oath &c(sic) that they did see the Testator herein named sign and seal this will that they heard him publish pornounce and declare the same to be his last Will and Testament that at the time of his so doing he was to the best of their apprehensions of sound and disposing mind memory and understanding and that they subscribedtheir namesto this will in the presence and at the request of the Testator and in the presence of each other, and that they saw John Betebenner do the same. - Certified by - Thomas Belt, Regr. Additional Comments: Note written on edge of Will says, "Crystal Caverns on this farm on road Boonsborom Keedysville Md" The words are typed as closely as the written words were spelled. I do not know what "&c" stands for.
