I Nancy Moats of Washington County in the State of Maryland being in reasonable health of body and sound and disposing mind and memory and understanding, considering the certainty of death and the uncertainty of the time thereof, and being desirous to settle my worldly affairs, and thereby be the better prepared to leave this world when it shall please God to call me hence, do therefore make and publish this my last will and testament in manner and form following that is to say. First and principally I commit my soul into the hands of God and my body to the earth to be decently buried at the discretion of my executor hereinafter named and after my debts and funeral charges are paid by my executor for and in consideration of that which I bequeath to him hereinafter named I devise and bequeath as follows . -Item - I bequeath unto Joseph Palmer of Washington County Maryland who is to pay my funeral expenses all my household effects all and singular: And also all that part of my little farm lying south of the village of Tilghmanton Washington County Md. and on the West side of the Turnpike leading from Hagerstown to Sharpsburg joining the land of John Snavely with all the buildings, during his natural life and from and after his decease I give the same to his son David his heirs and assigns. - Item- I give and devise unto Susan Nally wife of Joseph Nally of Washington County Md. my niece, one acre of land being a part of my Farm as above described but lying on the East side of said Hagerstown and Sharpsburg Turnpike and to be near off at South side where said land joins Jonathan Doup, during her natural life and then I give the same to her husband Joseph Nally if he should survive the said Susan, to hold during his natural life, and in the event of the death of both of the above named parties then the same to go to their son William. -Item- I devise and bequeath all the rest of my estate to Samuel Palmer, my nephew of Washington County Maryland, being a part of my Farm lying on the East side of said Hagerstown and Sharpsburg Turnpike and joins the land of Henry Moats and others during his natural life and from and after his decease I give the same to his three sons share and share alike, named Elmer, William, and Edward Palmer to be equally divided among them share and share alike and lastly I do hereby appoint and constitute my Nephew Joseph Palmer to be sole Executor of this my last will and testament., revoking and annulling all former will by one heretofore made, ratifying and confirming this and none other to be my last will and testament. In testimony whereof I have hereunto set my hand and affixed my seal this Sixteenth day of April in the Year of Our Lord One Thousand eight hundred and Seventy Seven. Whereas I Nancy Moats of Washington County, State of Maryland, have made and duly executed my last will and testament in writing bearing date the Sixteenth Day of April in the year 1877 which said last will and testament and every clause bequest and devise therein contained. I do hereby notify and confirm( saving and excepting such clauses, bequest and devices therein mentioned as are by me hereinafter revoked and made void) and being desirous to alter some parts thereof and making additions thereto I therefore hereby make this my Codicil which I will and direct shall be taken and held as part of my said will and testament in manner and form following that is to say: Whereas since the making of my said will, Susan Nally is dead now I hereby give and devise to Samuel Palmer the parcel of ground devised to Susan Nally and her husband Joseph Nally in and by my said last will and testament to him the said Samuel Palmer and his heirs and assigns in fee simple. In testimony whereof I have hereto set my hand and affixed my seal this Fourth day of October in the year 1879. Washington County, Maryland. Living with his wife Susan, age 28. 1870 U.S. Census, Joseph Nally, age 29, Washington County, Maryland. Living with wife Susan, age 27 and children Edy 7, Fannie 5, Josephine 2, and Laura 9/12 1880 U.S. Census, Joseph Nally, age 43, Washington County, Maryland. Living with wife Ann Sophia, age 29 and children Eda S. 16, Fannie R. 14, Josephine 12, William H. 9, Bettie May age 5, Agnes N. 2/12. Also step- children Clinton Koontz age 10, Bertha Koontz age 7, and Art Koontz age unknown. 1900 U.S. Census, Joseph Nally, Washington County, Maryland. Living with wife Martha, and son Jacob, daughter Ima, and son Winton. Joseph Nalley is buried in Bakersfield Cemetery, Washington County, Maryland along with third wife Martha Jane (Piper) Nalley. Also children Ellis and Nora. Son Winton and wife Othella are buried in the same family plot. 1850 census shows Nancy Moats aunt of Susan (Moats) Nally , at age 50 living next to her brother , Samuel Moats. I have yet to find the burial place of Susan. I have searched every cemetery in the Washington County area to no avail. She could have been buried on the plot of land given to her by her aunt Nancy.
