All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Michael Rohrer mrohrer@usa.com October 5, 2008, 2:26 am Source: Washington County Will Book C, Pages 635/636 Written: December 12, 1859 Recorded: October 28, 1862 LAST WILL AND TESTAMENT OF SAMUEL ROHRER DECEASED In the name of God amen, I Samuel Rohrer of Washington County and State of Maryland being rather weak in body, but of a sound and disposeing mind memory and understanding; considering the certainty of Death and the uncertainty of the time thereof; and being desirous of Settling my worldly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence, do therefore make and publish this my last will and testament in manner and form following, that is to say, first and principally I commit my soul into the hand of almighty God; and my body to the earth to be decently buried at the discretion of my executors herein after named; and after my just debts are liquidated and discharged, and my funeral charges are paid; I devise and bequeath as follows, first and foremost I will and bequeath to my dearly beloved wife Magdalena during her life, the small farm on which I now reside said to contain ten acres more or less, with all the improvement appertaining thereto, also all my household and kitchen furniture, also all my stock of horses cows and hogs, also all of my farming (essentials) consisting of a wagon, plows and harrows; with all & every other thing or things now in my possession; to have and to hold, for her own proper benefit during her natural life, and should it please God to spare the life of our dearly beloved son Jacob Rohrer who has been so kind & attentive to his parents after the death of his mother, I will & bequeath to him my dear son Jacob Rohrer all that I have willed to his mother, both real & personal to have and to hold for his own proper benefit and use forever. And lastly I do hereby constitute & appoint my dear son Saul Rohrer to be the Sole Executor of this my last will and testament revoking and annulling all former wills by me heretofore made; ratifying & confirming this and none other to be my last will and testament. In testimony whereof I have hereunto set my hand and affixed my seal this 12th day of Dec. in the year of our Lord, one thousand Eight hundred and fifty nine. Samuel Rohrer Seal Signed sealed published and declared by Samuel Rohrer the above named testator as & for his last will & testament in the presence of us who at his request in his presence and in the presence of each other have subscribed our names as witnesses thereto. Jno Troup Sr. Fisher Troup Joseph Troup State of Maryland, Washington County, to wit, On the 17th day of October, A.D., 1862, came Fisher Troup and on the 21st day of October A.D. 1862 came John Troup Sr., two of the three subscribing witnesses to the foregoing Last Will and Testament of Samuel Rohrer late of said county deceased, and severally made oath on the Holy Evangely of Almighty God that they did see the said named testator sign and seal this will, that they heard him publish, pronounce and declare the same to be his last will and testament, that at the time of his so doing he was to the best of their apprehensions of sound and disposing mind, memory and understanding, and that they subscribed their names as witnesses thereto at the request and in the presence of said testator and in the presence of each other and in the presence of Joseph Troup the other subscribing witness whom they saw dothe same. Sworn in Open Court, Test. Wm Logan Registor State of Maryland, Washington County, to Wit: Mr. Frederick Bryan, being duly sworn testified as follows: Witness was well acquainted with Samuel Rohrer, now deceased. Knew all of his family -- he had three sons all of whom are living. Martin lives in the west, Solomon and Jacob live in this county. Mrs. Rohrer has no son named Saul. Witness wrote the foregoing last will and testament of Samuel Rohrer deceased. He has always written Solomon's name Saul. Solomon was the son who was intended by his father to be his Executor, the mistake in styling him Saul was deponent's own and not the father's. Solomon was the son intended. He has written Solomon's name frequently and always wrote it "Saul". Mr. Samuel Rohrer never had a son named Saul, the mistake is my own. Sworn in Open Court, Test. Wm Logan, Registor State of Maryland, Washington County, to Wit: On this 28th day of October 1862 came Solomon B. Rohrer Executor of Samuel Rohrer, late of said county, deceased, and made oath on the Holy Evangely of Almighty God, that the foregoing is the true and whole will of said deceased that has come to his hands and possession, and that he doth not know nor hath he heard of any other. Sworn before Wm Logan, Registor Additional Comments: Mililani, Hawaii October 4, 2008 Samuel Rohrer, 1787-1862, was my great, great, great grandfather. His wife, Magdalena Rohrer, was one of seven daughters of Martin Rohrer, d. 1806, and his wife Christana Myer. Samuel and Magdalena were the parents of three children, all sons, two of whom are mentioned in the will. Bachelor son, Jacob Rohrer, was willed all of his father's real and personal property to take effect upon the death of his mother, Magdalena. The other bachelor son, Solomon B. Rohrer, a well known Hagerstown merchant, was named executor of the will. The third son, Martin Rohrer, is not mentioned at all in the will; however, he is named to in the codicil by Frederick Bryan--clearing up the name Sol vs. Saul--as living "in the West." Martin had indeed migrated sometime prior to 1840 to Stark County, Ohio, where he married and raised a family. It was Martin who became my great, great grandfather.
