Transcribed from a copy of the original, pgs 464 & 465, Registery of Wills, Hagerstown MD. In the Name of God, Amen. I, Jacob Shoop, of Washington County and State of Maryland, being of sound mind, memory and understanding but calling to mind the mortality of my body, do make and ordain this my last Will and Testament in manner and form following. I recommend my soul into the Hands of Almighty God that gave it and my body I recommend to the earth to be buried in a decent Christian Manner at the discreation of my executors as touching such worldly Estate wherewith it has pleased God to bless me with in this life. I give and dispose of it in the Manner and form following. viz(-?-) First to my beloved Wife Agnes all my whole estate both real and personal (my working tools excepted in manner and form hereafter mentioned) that is to say as long as she lives my widow, she is to have the whole benefit of my estate during her widowhood. After my Just Debts and funeral Expenses be paid, with one other legacy paid out of my estate by my executors hereafter mentioned. viz(-?-) I will and bequeath unto my son Jacob five Shillings current money to be paid to him by my Executors out of my estate for his full part of my estate. Further it is my Will and Desire that at my Wifes Decease or Marriage, which should first happen, that then all my estate be sold at public Sale and be equally Divided amongst my Children hereafter named and my Wife, if she is married, shall have one childs part amongst the Children below named, that is to say to my Sons Frederick, John, Henry, David, Daniel, Jonathan, Samuel, Peter and my daughters Elizabeth and Katharina, and as it appears that my wife is at this time pregnant, the child that she may be delivered of shall have an equal share with the others to be equally Divided amongst them by my Executors, my working tools excepted. I order and appoint them to be sold immediately after my Decease by my Executors to pay my Just Debts and funeral expenses and I further order that my Wife, as long as she remains a widow and lives upon my property, that she raise the small children untill they are fitt to put out to some good (trade). Further I appoint and constitute my trusted Friends, David Harry and Peter Woltz the sole Executors of this my last Will and Testament and I hereby utterly disallow all former Testaments, Wills and Legacies and Executions satisfying and confirming this to be my last Will and Testament. In Witness whereof I have hereunto set my hand and affixed my seal hereto this Twenty second day of August in this year of our Lord, Eighteen hundred and two Signed Sealed, published, announced and declared by the said Jacob Shoop as his last Will and Testament in the presence of us. David Ridenour (-?-)(-?-) Thomas Grieves Jacob Shoop SEAL On the back of the original Will of the aforesaid Jacob Shoop are the following endorsements to wit: Washington County (-?-) On the 9 day of October, 1803 came David Harry and Peter Woltz & made Oath to that the within instrument of writing is true & whole Will and Testament of Jacob Shoop Deceased and that they do not know of any other. At the same time came David Ridenour and Thomas Grieves two of the subscribing wittnesses to the written last Will and Testament of Jacob Shoop late of said county, Deceased, and severally made Oath on the Holy Evangels of Almighty God that they did see the Testator herein named Sign and Seal this Will. That they heard him publish, announce and declare the same to be his last Will and Testament, that at the time of his so doing, it was to the best of their Apprehensions,of sound and disposing mind and understanding, and that they respectively subscribe their names as witnesses to this Will in the presence and at the request of the Testator and in the presence of each other.
