MD Prerogative Court (Wills) 31, pp. 552-553 Elias Poynter, 29 January 1762 [MSA S538, MdHR 1310, 1-11-1-40] In the Name of God Amen January ye ..Day 1761 I Elias Poynter of Worster County and Province of Maryland Planter being in Health and of a Perfect mind and memory thanks be to God for It I do make and ordain this my Last Will and Testament in manner and form following first of all I commit my Soul to God who gave it me and Body to the Earth to be Buried in a Christian like and Desent manner as my Exetrix hereafter Named shall Think Propper and Convenient and as for touching such worldly Estate as it hath Pleased God to bestow upon me I give and Dispose of the same as followeth Imprimis I give and Bequeath to my son Thomas Poynter one Hundred and Seventy Two acres of Land being apart of highField to him his heirs and assigns if in case my Son Thomas Poynter should not Pay the Money Due to John Smith or his Heirs, that I give and Bequeath Fifty acres of the aforesaid Tract of Land to my Brother in Law John Smith to him his heirs and assigns..I give to my Son Thomas Poynter one old cow and heifer and one cubbord to him his and his assigns Likewise one Great Pott and one little to him and his Heirs and assigns I give and Bequeath to my Daughter Mary Poynter one Brindle Cow and yearling and the young Mair excepting the first colt she shall bring to be the Right and Property of my Daughter Rhoda Poynter, and I give to my Daughter Mary Pointer one midling Pott Item I give and Bequeath to my Daughter Rhoda Pointer one whitefaced cow and yearling and one small Pott and one Bed and Furniture, one young Heifer to her and her assigns and all other wills I do Revoke Disannul and Renounce and this I declare Public and Pronounce to be my Last Will and Testament in Witness whereunto I have Set my Hand and affixed my Seal this day before Written. Smock Jr. Obediah Gladstone Jr. Thomas Burbbgg Jr. January 29: 1762 Came Smock, Obediah Gladstone and Thomas Burbbagg the Subscribing witness to the foregoing will and made oath on the Holy Avangelis of Almighty God that they saw Elias Pointer the Testator Sign Seal and Heard him publish Pronounce and Declare the same to be his Last Will and Testament and that at the time of his so doing he was to the best of their apprehension of a sound disposing mind and memory and that they subscribed their Names as Witnesses to the said Will in the Presence of the Testator and at his Request Sworn before Benton Harris Depty Commissary of Worcester County [This will proves that Elias was the son of Thomas Poynter and one of his two wives, because Eleanor Poynter, daughter of Thomas was married to John Smith and is mentioned above as Elias' brother-in-law.
