WE COMMAND YOU to attach the Goods and Estate of William L. Malcolm of Jefferson in county of Lincoln + State of Maine The value of fifty dollars and summon the said Defendant (if he may be found in your precinct) to appear before our Justices of our Supreme Judicial Court, next to beholden at Skowhegan, winthin and for the county of Somerset, on the third Tuesday of September A. D. 1895 then and there in our said court answer unto: Erdine D. Malcolm of Fairfield in the county of Somerset and State of Maine in a libel for divorce, wherein the libelant alleges that she was married to the said libelee at Jefferson in the said State of Maine on the 14th Day of April A.D. 1890. That said libelant and libelee cohabited in this State after their said marriage: that said libelant and libelee resided in this State when the cause of divorce accrued as herein after set forth and had resided here in good faith from the date of their said marriage until the date hereof: that your libelant has ever been faithful to her marriage to her marriage obligations but that the said libelee has been unmindful of the same: that on the day of September A.D 1893 he utterly deserted your libelant without reasonable cause and has continued said desertion ever since: that being of sufficient ability or being able to labor or provide for her has grossly wantonly and cruelly neglected and refused to provide suitalbe maintenance for your libelant: that he has been guilty of cruel and abusive treatment and extreme cruelty towards her: That two children have been born to them during their said marriage both now living viz: Earl Linwood aged three years and Georgia Dean aged two years. Wherefore she frays that a divorce from the bonds of matrimony between herself and the said libelee may be decreed and that the care and custody of their minor children may be given to her: Also that reasonable alimony be decreed to her out of his estate or in lien thereof that a specific sum be paid to her by him. Erdine D. Malcolm to the damage of said Plaintiff (as she says) the sum of fifty dollars. This libel was presented and entered at this term of this court in this county Sept 1895 when the libelee though called to come into court does not appear but makes default. The libelant appears and prays judgment. The foregoing libel being seen and fully understood by the Court here it is considered that the material facts and allegations therein contained are satisfactorily proved. It is therefore ordered that the bonds of matrimony now existing between the said libelant and libelee be and the same are herely dissolved. Custody of minor children given to mother. The defendant is ordered to pay the plantiff ten dollars a month to aid her in the support of the children executions to the issue therefor.
