The fifteenth day of May, one thousand seven hundred & ninety two. I, Joseph Hamilton of Berwick in the county of York, yeoman, being sick of body, but of perfect mind + memory, thanks be to God therefore: I do make and ordain this my last Will and Testament. First of all I do recommend my soul into the hands of God that gave it; and my body I recommend to the earth to be buried in decent + christian burial at the discretion of my executor, nothing doubting but at the general resurrection, I shall receive the same again by the mighty power of God. And as touching such worldly estate wherewith it hath pleased God to bless me with, I give, demise and dispose of in the following manner & form. I give and bequeath to my well beloved wife Elizabeth Hamilton a comfortable support out of my estate, during the time she shall remain my widow; to be provided for by my son, Jonathan. I give and bequeath to the heirs of my deceased daughter, Abigail Clark, five shillings, to be paid by my son Jonathan. I give and bequeath to my daughter Sarah Perkins one half of all my household furniture, at the decease of her mother, to be paid by my son Jonathan. I give and bequeath to my grandson Joseph Perkins one cow, + calf at the decease of his grandmother, to be paid by my son Jonathan. I give and bequeath to the heirs of my deceased daughter Elizabeth Tebbelts, five shillings, to be paid by my son Jonathan. I give and bequeath to my daughter Mary Rollins, one cow, the remaining half of all my household furniture at the decease of her mother, to be paid by my son Jonathan. I give and bequeath to my son Jonathan Hamilton, all the remainder and residue of my estate real and personal, he to support his mother as above ordered, and pay my just debts and funeral charges, and legacies before given; to him his heirs and assigns forever. I do make constitute and ordain my son Jonathan Hamilton sole executor of this my last will and testament. And I hereby utterly disallow revoke and disannul all + every other former wills, + legacies; ratifying confirming this and no other to be my last will and testament. In witness whereof, I have hereunto set my hand & seal the day & year within written. his Joseph X Hamilton (seal) mark Signed sealed published pronounced & declared by the said Joseph Hamilton to be his last will & testament in the presence the subscribers: John Libbey Moses Nock Ithiel Scates York At a Court of Probate, held at Berwick, May 20, 1799. The foregoing instrument was presented for probate; Moses Nock & Ithiel Scates, two of the persons whole names are subscribed as witnesses thereto, personally appearing make solemn oath that they saw the said Joseph Hamilton the testator, sign seal and heard him declare the said instrument to be his last will and testament, that he was then of a sound disposing mind according to their best judgement; and that they together with Joseph Libbey subscribed their names as witnesses to the said instrument, in presence of said testator. And no objection being made against the said instrument, I do therefore approve and allow the same as the last will and testament of the said Joseph Hamilton deceased; and do hereby order and direct the said executor to make known his appointment by posting up notifications there of in some public places in the said town of Berwick, and in the two next adjoining towns, within three months. In testimony whereof I have hereunto set my hand and caused the seal of said Court of Probate to be hereunto affixed the day + year aforesaid.
