Dops, of the 9th Regiment of Iowa Vols at Maquoketa Iowa on the seventh day of August 1861, to serve three years; he was born in Charlotte in the State of Vermont, is 31 years of age, 5 feet 10 inches high, dark complexion, black eyes, black hair, and by occupation when enlisted a Blacksmith. During the last two months said soldier has been unfit for duty 60 days. Has been unable for duty 9 months. Station: Genl Hospl. Date: Nov 3, 1862. I certify, that I have carfully examined the said Henry F. Spear of Lieut A. D. one thousand eight hundred and eighty six a court of record within and for the County and State aforesaid Henry F. Spear aged 55 years, a resident of the Township of Heath, county of Allegan, State of Mich. who, being duly sworn according to law, declares the he is the identical Henry F. Spear who was enrolled on the 9th day of Aug, 1861, in Company A of the 9th Regiment of Iowa commanded by Lieutenant Riley and was honorably discharged at Memphis, Tenn on the 4th day of Dec, 1862: that his personal description is as follows: Age, 55 years; height Five feet ten inches; complexion, Dark; hair, Dark; eyes, Black. That wile a member of the organization aforesaid, in the service and in the line of his duty at Camp Cross Timber in the State of Ark. on or about the 15th day of March, 1862, he contracted chronic diarrhea and piles, and also enlargements of the joints of the feet or bunions. That he was treated in hospitals as follows: At Batesville, Ark, in May 1862. That he has ______ been employed in the military or naval service otherwise than as stated above. Re-enlisted in Co."B," 11th Mich. Cav., Oct 22, 1863. Discharged Aug. 14, 1865. That since leaving the service this applicant has resided in in the Counties of Ottawa & Allegan in the State of Mich, and his occupation has been that of a Farmer & Carpenter. That prior to his entry in to service above named he was a man of good, sound, physical health, being when enrolled a Blacksmith. That he is now partly disabled from obtaining his subsistence by manual labor by reason of his injuries, above described, received in the services of the United States; and he therefore makes this declaration for the purpose of being placed on the invalid pension roll of the United States. He hereby appoints, with full power of substitution and revocation, JOS H. HUNTER, of Washington, D. C., his true and lawful attorney to prosecute his claim. D. 1893, personally appeared before me, a a Notary Public in and for the aforesaid County, duly authorized to administer oaths, Kinsey Martin aged 62 years, a resident of Heath in the County of Allegan and State of Mich whose Post Office address is Dunningville, Allegan Co MIch and Edgar H. Martin aged 33 years, a resident of Heath in the County of Allegan and State of Mich whose Post Office address is Dunningville Allegan Co Mich well known to me to be reputable and entitled to credit, and who, being duly sworn, declares in relation to aforesaid case, as follows: Each says for himself as follows; I have known claimant intimately for the last 10 years, living near neighbors to him in said township and intimate with him. I know his health has been during past 10 years very poor. He has been during this past 10 years entirely unable to support himself by manual labor. His disabilities so far as I know specifically are as follows. He has suffered greatly with piles during this 10 years. He has also presented the appearance of suffering from heart trouble, short breath and his general infirm condition and air cumberance indicate his diseases. I think he has suffered from heart disease and I, said Kinsey Martin further say, to my knowledge he has had rupture or hernia, about 1st of July 1890 was the first time I knew that he suffered from it then and showed it to me and has been so afflicted to present time. I, said Edgar H. Martin in regard to that say as to my knowledge about it I did not know he was afflicted with hernia or rupture till recently; a few days ago I saw it as wide as my two fingers and ridged up about 3 inches long. Each affiant for himself says that in conversation with claimant dating back to our first acquaintance with him he has heard him attribute his disability to the chronic diarrhea which he stated that he contracted in the army service and each further says that the disability of claimant from said stated causes is not in his judgment the result of vicious habits. I know of no specific cause of his hernia. His statement about it has been that it came upon him gradually. He did not know what caused it unless it was caused by the chronic diarrhea piles probably resultant from diarrhea and stomach [one word here]. He is and has been while we have known him a man of good personal habits. He has not while we have known him been addicted to vicious habits of any kind. He is a man in good repute for sobriety and worthy habits and we each believe that none of said disabilties result from any vicious habit or practice. I further state that this testimony was all written in my presence from my oral statements then made at the date aforesaid at Allegan Mich at the office of William W Warner Esq, dicatated by me, written down by him, said W. M. Martin and in making the same he did not use and was not aided or prompted by any written or printed statement (or recital, prepared or dictated by any other person) and not have it attached. His post office address is Dunningville Allegan Co Mich. He further declares that he has no interest in said case and he is not concerned in its prosecution. State of Michigan, County of Allegan,, ss: In the matter of Accrued pensiion claim Phebe Spear, widow of Henry F. Spear, Late Priv. Co A 9th Regt Ia Inf Vols and Co B 11th Regt Mich Cav Vols. On this 20 day of January, A. D. 1899, personally appeared before me, a Notary Public in and for the aforesaid County, duly authorized to administer oaths, Chas. C. Spear aged 70 years, a resident of Englewood in the County of Cook and State of Illinois well known to me to be reputable and entitled to credit, and who, being duly sworn, declared in relation to the aforesaid case as follows: Said Henry F. Spear was my brother. As to his marriage relations He lived when a young man in Ottawa Co Mich Town of Blendon. He lived here in Ottawa Co till about 1855. All I know is by infirmation as Matter of Family History that he married in Iowa. I have before me a little book, Advice to Married People, on fly leaf is written "E H Spear" Presented by Rev Mr Pollir, Maquoketa, Ia Dec 31, 1857, and further on is a Marriage Certificate which read as follows, "This certifies that Mr Henry F. Spear and Miss Elizabeth H. Nims were by me united in marriage according to the Laws of the State of Iowa at Maquoketa Iowa Dec 31, 1857. J. H. Pollir, Minister of the gospel." I never saw his wife, said Elizabeth H. Nims nor their children. They had two boys. The war came on and he went to the War - Co A 9th Ia Vols - I understand that his wife died abou the time he went into the war - The two boys died soon after. He got sick in army and was discharged - His wife and one child was dead. His wifes father kept the other child. He came to Michigan and again enlisted - He never was married except as above stated until he married Phebe Woodruff - in Ottawa County Mich. in the Fall of 1865. She was a widow - They lived together is marriage till his death. They were never divorced. He died at Allegan Mich Jan 18, 1899 at his residence. His Post Office address is Stu O So Halstiad St - 68 - 10 - Englewood, Cook Co, Ill. He further declare, that he has no interest in said case and he is not concerned in its prosecution. Spear, deceased; that he died on the 18 day of January, 1899; the he had been granted a pension by Certificate No. 432.527 which is herewith returned that he had been paid the pension by the Pension Agent at Detroit Michigan up to the 4 day of Dec, 1898; after which date he had not been employed or paid in the Army, Navy or Marine service of the United States, except no exceptions; that she was married to the said Henry F. Spear on the 25 day of October, 1865, at Blendon Ottawa Co, in the State of Michigan; that her name before said marriage was Phebe S. Nims aged _______ years, a resident of Maquoketa in the County of Jackson and State of Iowa whose Post-office address is Maquoketa Jackson Co Iowa well known to me to be reputable and entitled to credit, and who, being duly sworn, declares in relation to the aforesaid case as follows: I know said Henry F. Spear from about 1857 when he married Elizabeth H. Nims my cousin at Maquoketa Iowa - I never knew of his being married until he married her - They lived in the marriage relation at Maquoketa until her death. She died just prior to his enlistment in said Co A 9th Ia Cav. I had personal knowledge of her death and burial. A tombstone was erected soon after in her memory. It stands in the cemetery here. I have seen it often and recently. The inscription states the date of her death as Aug 5, 1861. I know she died just prior to his enlistment. He did not again marry, not to my knowledge until he married claimant above named in Michigan, nor was he ever married except as above stated until he married claimant not to my knowledge and I had not personal knowledge of his marriage with claimant in Michigan. Spear and Henry F. Spear late her husband for about twenty years during all which time they have lived together in the marriage relation in Allegan County at towns of Heath first, afterwards at Allegan. They never were divorced either of them from the other not to my knowledge and I should have been apt to have known of it if they had been. I was at his house and saw him a day or two before he died. He was very weak and feeble - pretty debilitated then in flesh. The widow has not remarried. Said soldier at his death left surviving him no child or children by her or any former wife who was at his death under 16 years of age. The time I knew him was during the last twenty years. She died just prior to his enlistment in said Co. A 9th Iowa Cav. I have personal knowledge of her death & burial. I was at the funeral. She died Aug 5, 1861. Her Post-office address is Maquoketa Jackson County Iowa. She further declares that she ahs no interest in said case and is not not concerned in its prosecution. Signature of affiant Bettie Nims.
