ROSE [The Hastings Banner, Thurs., February 18, 1904, front page, bottom of 4th column] ROSE--Died at the home of his niece, Mrs. J. Roland Clark, in Grand Rapids, Friday, of an acute attack of laryngitis, Benjamin R. Rose, aged 74 years, 1 month, 23 days. Deceased formerly resided in this city and vicinity, where he spent many years of his life, and had a large acquaintance. He was especially active in Masonic lodge work. For the past two or three years he has resided in Grand Rapids. The funeral was held Monday at Woodland, interment being made in the Fuller cemetery. The funeral was held at the United Brethren church in our village. ---------------------------- [The Hastings Banner, May 4, 1905, pg 3, ol 3] JURY DISAGREED IN CASE OF IDA FURNIA AGAINST THE ESTATE OF B.R. ROSE The Jury in the case of Mrs. Ida Furnia, of Ludington, who claims to be the sold heir of the late B.R. Rose, which case was tried in the Kent Couty Circuit Court, did not agree. The judge submitted three questions for the jury to consider, as follows: 1. Was Ida Furnia the child of the late B.R. Rose? 2. If so, were her father and mother lawfully married? 3. Was Ida Furnia omitted from the will of B.R. Rose by accident or mistake? We are informed that on the first question the jury was unanimous. On the second they disagreed, and also on the third. We have not learned whether or not the case will be tried again. Benjamin R. Rose's Civil War Invalid Pension Cert. #216321, 20 May 1904, Pv. K 6, Mich. Vol. Cav. "State of Michigan, County of Barry "In the matter of the Invalid Pensioner Claim of Benjamin R. Rose No. 304691 "The above named applicant being duly sworn says that for five years immediately preceding his enlistment in the fall of 1862 in Co. "K," 6th Rgt. Michigan Cavalry in the late war of the rebellion he was a resident of the township of Carlton in Barry County Michigan, and his occupation was farming. "That his disability occurred in January or February after his enlistment. He was taken sick at waiting in D.C. and was quite ----- sick in Reg--- Hospital with inflammation of the lungs and was so sick as not to do duty for about four months. That said sickness left him in a weak state of health and worked in hospital after that. That after that he was discharged to wit in June 1865 and was soon thereafter taken sick and could not and did not leave Lincoln Hospital at Washington D.C. for three or four weeks after said discharge and was --- sick. "That after that he went to Orleans Co, NY and was again taken sick with lung difficulty and a disease of the bowels and general debility and was quite sick then for two or three months and was doctored at that time. "Doctor Frost who now lives at Hudsonville, Ottawa Co, Mich. That after his recovery from said sickness at Orleans Co, NY he came to Barry Co, Michigan where he has ever since lived except about two years in 1868 and 1869 when he ived at Berlin, Ionia Co, Mich. "That during all that time he has been constantly troubled with weak lungs, looseness of the bowels and general disability, and has not been able during any time since his discharge to do hard manual labor and has done none. "That his occupation has been looking after a farm he owns but not to do any work on the farm. Has worked at fire and life insurance some of the time and done what light work he could, but could not and has not done any hard work or any manual labor. "I was doctored by H. Tremayne, M.D., who lived at Berlin, Mich. in the years 1869 & 1869. That he attended me through a ---- fit of sickness the trouble then being with my lungs & bowels. That said Tremayne now lives at Ionia, Ionia Co. Mich and has occasionally doctored me since that time. That in the year 1872 & 18733333, A. P. Drake, M.D. of Hastings, Mich. doctored me for chronic bronchitis & pneumonia with general debility. That I was very sick during his attendance on me in said sickness. That from 1874 to 1879, Charles Russell, M.D. of Hastings, Mich. who now lives in Allegan, Mich. was my family physician. That I had during that time two prior attacks of inflammation of the lungs and abdominal viscera with ---- prostration. That when sick, very sick. I was unable to do but little. That during said attendance of said Russell when I was very sick Dr. Drake attended with Dr. Russell. That at present Dr. Drake of Hastings is my family physician and prescribes for me frequently. That for past year and a half function(?) says not. B. R. Rose "Subscribed and sworn before me this 14th day of December AD 1880 & testify do witnesses to be respectable and attend to ----- and that I have no intent in this ---- My P.O. address is Hastings, Mich. Clement Smith, Judge of Probate for Barry Co, Mich." "General Affidavit, State of Michigan, County of Ottawa "In the matter of the application of Benjamin R. Rose a private in Co. K, Mich. Cavalry "Personally came before me a Justice of the Peace in and for aforesaid County and State, Aaron C. Frost a citizen of the COunty of Ottawa, State of Michigan, well known to me to be reputable and entitled to credit, and who, being duly sworn, declares in relation to aforesaid case, as follows: "Reside at present in the village of Hudsonville, Ottawa County & State of Michigan and have resided here the past seven months, previous to that I resided in the village of Waterport, Orleans County, State of New York. I have been during the past 23 years a physician and surgeon and am now engaged in that business. I have known the said Benj. R. Rose since July 1865. In July 1865, and in the fall of 1866, and again in February and March 1867, I treated him for disease of the lungs & abdominal visera. I have no doubt but his disease was caused by exposure. He has not since that time I first saw him been able to labor and in my opinion will never be able to. I have often seen the said Benj. R. Rose since I last treated him, and have examined his lungs, at different times. My Post Office address is Hudsonville, Ottawa County, Michigan.
