All rights reserved. http://usgwarchives.net/copyright.htm http://usgwarchives.net/mi/mifiles.htm ************************************************ SUBJECT: The Will of Simeon McCotter, 1891 SUBMITTER: Cathy McCotter Pouls EMAIL: japouls@prodigy.net DATE: Jul 22, 1999 SURNAMES: MCCOTTER In the name of God, Amen: I, Simeon McCotter, of Vermontville, Eaton County, Michigan, being of sound mind and memory, but mind of the uncertainty of this life do make and publish this my last Will and Testament, as follows: First: I desire that my just debts and the expenses of my last sickness and of my burial and of a suitable monument be paid out of my personal estate, or if that be not sufficient therefore, out of my real estate, to be raised by a mortgage of said real estate to be executed by my executor hereinafter named, payable after the death of my beloved wife. Second: I give, bequeath and devise unto my beloved wife, Minerva L. McCotter, in case she survives me, all of my real and personal estate, of whatever kind of nature, and wherever interests to have and to hold, use and enjoy, for and during her natural life - and if the annual proceeds thereof are not sufficient for her comfortable support, I do hereby authorize my executor hereinafter named to sell or dispose of any part thereof and apply the proceeds of the same to her support. Third: Upon and after the decease of my said wife, in case she survives me, I direct that all of my property then remaining undisposed of, be divided and distributed as follows: I desire that the various articles presented to us or either of us by our children be returned and redisposed to the several donors; that a just allowance be made by the Probate Court to my son, James H. McCotter, for the various necessuries and comforts by him applied to us during recent years, and be paid to him although he has made no charge therefor; and that the residue of said state be divided in equal shares between my sons, James H. McCotter, George S. McCotter, my daughter, Eliza Gage and my grand-daughter, Effie Sackett, or in case of the death of either, his or her share to go to his or her children. Fourth: In case I shall survive my said wife, I direct that at my death, all of my estate be divided and distributed in the same manner as provided in the first and third clauses of this Will, without any intervening life estate. Fifth: I hereby nominate and appoint my friend, Sidney S. Rockwell of Vermontville to be sole executor and trustee under this Will, witness my hand and seal this 20th day of July A.D. 1891.
