The boys, with two companions, were playing Indian, and Stuart was the cowboy defending a fort which the boys had built on the outskirts of the town while the other three boys were the Indians and were trying to capture him. As they approached the fort, Stuart met them at the door with a 22-caliver rifle, that the boys had been using in their make- believe Indian warfare. According to statements made by the boys, Tuller grappled with him, and the weapon was accidentally discharged. The bullet entered under the right eye and pierced the brain. The unfortunate boy was a nephew of Arthur Leary, the liveryman, of this place, the boy’s mother being Mr. Leary’s sister.
