Hawley in the petition of Ernest E. Wagar and Marion Page Ross, trustees, for a construction of the will of the late Humphrey R. Wagar, Sr. According to Judge Hawley’s interpretation, the will stipulated that the estate was to remain intact until after the death of the last surviving child. It was then to be divided equally among the grandchildren or their heirs. When the decree was drawn up, Ernest Wagar was the sole remaining child. However, he died at his Washington, D.C. home late last week, shortly after returning from a visit in Ionia. His body was brought here for burial this week. Therefore, the heirs who will now receive equal shares will be Humphrey R. Wagar, Jr., Portia Marshburn and Marion Page Ross-Greenwood. A previous ruling of the judge stated that the death of another grandchild, Wellington Case Page, previous to that of his grandfather, excluded his heirs from sharing under the provisions of the will.
