Stewart aged 42 years, a resident of the town of Oak Park county of Benton State of Minnesota who, being duly sworn, according to law, declares that he is the identical John K. Stewart who was ENROLLED on the 22nd day of July, 1861 in Company "E" of the 30th Regiment of Ills. Vols. Commanded by Col. Fouk McClernand and was honorably DISCHARGED at Louisville, Ky on the 17th day of July 1865. Height 5 feet 10 inches light complexion, color of hair auburn. That while a member for the organization aforesaid, in the service and in the line of his duty at July 1861 to Oct. 1864 he contracted rheumatism affecting him generally from the extremes and hardships of Prison Life there, and he has suffered from same and the results thereof, more of less, eversince. That he was treated in hospitals as follows: no hospital treatment. That he has not been employed in the military or naval service otherwise than as stated above. That since leaving the service this applicant has resided in the county of Benton, except in Randolph Co., Ills. from 1865 to 1868 and in Dakota Co. Minn. from 1868 to 1870 of the State of Minn. and his occupation has been that of a laborer. That prior to his entry into the service above named he was a man of good, sound, physical health, being when enrolled a laborer. For five years immediately preceding my enlistment into the service of the United States on the 22nd day of Sept. 1861, I resided in the following named places: Randolph County, Illinois and my occupation was that of laborer. Since my discharge from said service, I have resided in Randolph County, Illinois from 1865 to 1868, and in Dakota County, Minnesota from 1868 to 1870, and in Hennepin County, Minnesota from 1870 to 1872, and in Benton County, Minnesota from 1872 to 1888 and my occupation has been that of a laborer. From my said discharge to the present time, I have received the following medical treatment for the disability alleged in my Declaration: Dr. Stewart of St. Paul, Minn. from 1868 to 1870, Dr. Leonard of Minneapolis, Minn. from 1870 to 1872, Dr. Sinclair of St. Cloud, Minn. from 1872 to 1875, Dr. Cheney of Sauk Rapids, Minn. from 1878 to 1880 and Dr. Dimler of Oak Park, Minn. from 1880 to date. Dr. Stewart died about 1882 and Dr. Cheney died about 1884. Since the origin of the disability for which pension is claimed, I have suffered with the following acute diseases: Continual aching in the parts affected, at times worse than others, can not state positive date of my attacks for which I was treated by Dr. Edward Dimler of Oak Park Minn. and the other doctors above named. And during all the said time, my physical condition and ability to perform manual labor have been as follows: I have performed manual labor as a farm hand cannot give dates when I have been disabled as they were so frequent. Personally appeared before me, a Clerk of the District Court in and for aforesaid County and State Dr. Edward Dimler who, being duly sworn, declares, in relation to aforesaid case, as follows: That his residence and P.O. Address are as follows: Oak Park, Benton County, Minnesota that he has been a practicing Physician for 23 years, and has been acquainted with said soldier for about Eight years; that he has had knowledge of him and his disabilities as follows: I did not know the above named John K. Stewart before the war. I first became acquainted with him in 1880 when he called upon me to treat his Rheumatism. I went and found him suffering with that disease. I gave him physic to remove inflammation and inasmuch to apply internally his physical condition was poor. I can not give the different dates of treatment afterwards as I have kept no memorandum of them, but he has been under my care ever since I first knew him and has been using medicine continuously prescribed by me for Rheumatism and frequently each year at times when he was worse than others he has called upon me to visit him, his disease is chronic and chiefly in his spine and hip joints. Extending at times down to the legs and at others upwards through the body from 1880 to 1886 inclusive he was each year from his disability unable to perform manual labor at least one half of the time and from 1886 to date about three quarters of the time. It is my opinion that he contracted said disease from exposure in the army. Since I have known him, his habits have been good and temperate. And he further declares that he has no interest, either direct or indirect, in the prosecution of this claim. Dr. E. Personally came before me a Clerk of District Court in and for aforesaid County and State said Stewart. who being duly sworn, declares in relation to aforesaid case as follows: that for the reasons stated I the enclosed attached paper he unable to file further medical or lay evidence of his condition since discharge. July 14th, 1888 To H. D. Phillips, Esq. Dear Sir, I am compelled to have my brother and sister in law execute blank "C" as it is impossible for me to get any others, simply because while I had frequent and often severe attacks each year after the first one I felt in Andersonville, yet I paid little attention to them further than use some liniments given to me by the Drs. I have named in a previous blank and consequently complained but little if any of my suffering to anyone outside of my own family. But each year it has been getting worse and since 1874, I have been compelled, at times, to have medical treatment other than liniments, and this has been given by Dr. Cheney of Sauk Rapids, Benton County, Minn. and Dr. Dimler of Oak Park, Benton County, Minn. The former is dead and the latter's testimony is sent in. and I have learned since I sent in my last blanks that Dr. Leonard is dead. How long since I could not learn. And Dr. Sinclair moved from St. Cloud about 11 years ago and his whereabouts cannot be ascertained. But I do not think either of their testimony would be of any service as I only got prescriptions for the rheumatism and pain for them and had no other treatment and therefore I believe that they could not, if alive or here, give a competent testimony. Stewart, Pvt, "E", 30th Ill. Vol. for Pension. Personally came before me a Clerk of the District Court in and for aforesaid County and State, W. J. Stewart and Annie E. Stewart well known to me to be reputable and entitled to credit, and who, being duly sworn, declare each in relation to aforesaid case as follows: That affiants well know said soldier, and have known him for the past 35 and 20 years respectively: that soon after his discharge and return home, on or about the month of August 1865 to December 1868 they saw and conversed with him familiarly , and he was then suffering from rheumatism and effects thereof, which he then said he had incurred in the army, in the line of duty; that his general appearance and symptoms then were as follows: His complaining of severe pain in his back and hip joints and his inability to move himself without help for a time and after he was able to walk was compelled to walk bent while the pain remained. Sometimes the rheumatism has been in his neck and shoulders at which times he could not turn or move his head that he has continued to suffer from same, and the resulting effects thereof, with like symptoms, more or less, ever since, and by reason thereof, in each year, since discharge, has been incapacitated for manual labor to the extent of (1) one quarter on an average, and is so now, to the extent of (1) three quarters, and that their means of knowledge as to foregoing facts are as follows: (2) Have lived part of the time in the same house with him and the remainder of the time as his near neighbor that, in the opinion of the affiants, the same was caused by his said service in the army, and has not been aggravated nor prolonged by intemperance or other bad habits. They further declare each that they have no interest in said case, and are not concerned in its prosecution, and are not related to said applicant as brother and sister-in-law. W. J. Lindsay Steele aged 51 years, a resident of Chester in the County of Randolph and State of Illinois whose Post Office address is Chester, Illinois well known to me to reputable and entitled to credit, and who, being duly sworn, declared in relation to aforesaid case as follows: I knew John K. Stewart from boyhood he was raised near me and worked for My Brother. I know when he enlisted in Company E, 30th Ills. Inft. in Sept. 1861 he was as stout and healthy a young man as was in the company and was a good soldier. I remember that when I took charge of the company in March 1865 at Goldsborrough, N.C., John K. Stewart complained to me that he had severe pains all over him and often could not march in ranks. On more than one occasion I had him go to the Regimental Surgeon, Dr. Joseph McCook who is now dead and the Doctor told him it was rheumatism, he was often excused from night Duty on the account of said rheumatism from March 18th 1865 to July 17th 1865 when we were Discharged. Since which time I have very seldomseen the said John K. Stewart and for the Last twelve years, I haven't saw him at all. The above is from personal knowledge and being in command of the company. January 16, 1889 We hereby certify that in compliance with the requirements of the law we have carefully examined this applicant, who states that he is suffering from the following disability, incurred in the service, viz: Rheumatism Pulse rate per minute, 98; respiration, 22 ; temperature; 37C; height 5 feet 11 inches; weight, 175 pounds; age, 42 years. He makes the following statement upon which he bases his claim for Original that he contracted rheumatism in Andersonville prison Upon examination we find the following objective conditions: Skin white and moist, Tongue coated; Gen. appearance fair, Heart: hypertrophied, apex beat is three fingers below and to Nu outside of mammary line. Joints, shoulders are slightly stiff, right shoulder bone has a cracking noise on motion, left is painful and swollen, other joints are normal. Liver and spleen are normal From the existing condition and the history of the claimant, as stated by himself, it is, in our judgement, ____ probable that the disability was incurred in the service as he claims, and that it has not been prolonged or aggravated by vicious habits. Dec. 2, 1889 Sir: To further aid this Bureau in determining the merits of the above entitled claim for pension, be kind enough to answer in your own handwriting the following questions, giving more complete details than your affidavit affords. Answer: About the last of August 1865. I fix the date from the fact of his arrival hence and other incidents which occurred at the time. Of what disability did he complain, and how was he affected? Answer: Of rheumatism. Frequently by severe pain in his Spine or hip joints and other parts of the body. How frequently have you seen him since your first acquaintance? Answer: Almost every day since his return from the army. If he has continued to suffer with such disability, please describe the symptoms which were apparent to you, and state to what extent he has been disabled for manual labor thereby during each year? Answer: Some of the symptoms apparent are sudden attacks of pain rendering him entirely helpless he cannot move nor be moved without extreme suffering. This pain is generally in his back - From 1/2 to 3/4 and at present almost wholly. My means of knowing the facts of the case are these: Have lived a good share of the time in the same house. Stewart, aged 44 years, a resident of Granite Ledge, County of Benton, State of Minnesota, who, being duly sworn according to law, declares that he is a pensioner of the United States by certificate number 488455, and duly enrolled at the Milwaukee Pension Agency, at the rate of Eight dollars per month, by reason of disability incurred in the Military service of the United States while serving as Private Co. E, 30th Illinois Infantry that his present physical condition is such that he believes himself entitled to receive and increased pension. I have been acquainted with the above named Soldier and his widow, Elizabeth J. Stewart, Since the year 1868 and I personally know that they lived together and were never divorced from that time till he died in the Town of Granite Ledge, Benton Co., Minnesota, on the 15th day of January, 1913.
