Elias A Gray



  This indenture made this second day of August A D eighteen hundred and 

fifty eight by and between Hans Arneson Hogina Arneson his wife of the 

County of Fillmore and State of Minnesota party of the first part and 

Elias A Gray of the same place party of the second part  Witnesseth that 

the said party of the first part for the consideration of one hundred and 

twenty dollars to me paid by the party of the second part the receipt of 

which is hereby acknowledged doth by these presents grants bargain sell 

and convey and confer unto the said party of the second part his heirs 

and assigns forever the certain tract or parcel of real estate Situate in 

the County of Fillmore and State of Minnesota to wit



  The East half of the South East quarter of Section No Eight in Township 

No One Hundred and one North of Range No Eight West of the fifth 

Principal Meridian



  To have and to hold the same with all the appurtenances thereunto belong 

unto the said party of the second part his heirs and assigns forever the 

said Hans Arneson will forever warrant and defend the title against all 

persons whomsoever provided nevertheless if the said Hans Arneson shall 

pay or caus [sic] to be paid to the said Elias A Gray or his heirs or 

executors the sum one hundred and twenty dollars according to the 

conditions of a certain promissory Note bearing even date herewith then 

this Deed shall be null and void but if the said money be not paid at the 

time specified the said party of the second part is authorized to sell 

said premises at public auction and carry the same to the purchases and 

out of the money arising from said sale to retain the principal and 

interest which may then be due on the said Note and also all costs and 

charges and pay the over plus to the said Hans Arneson or his heirs and 

assigns



  In testimony whereof the said party of the first part have here unto set 

their hands and seals the day and year first above witness

Be it known that on this second day of August A D 1858 before the 

undersigned came Hans Arneson to me personally known to be the identical 

person whose name is subscribed to the within Deed as granted and 

acknowledged the instrument to be his voluntary act and Deed and the said 

Hogina wife of Hans Arneson in absence of her husband acknowledged to me 

that she subscribed the said Deed voluntarily without fear or compulsion

  I Elias A Gray of the County of Fillmore and State of Minnesota do hereby 

certify that the written mortgage bearing the date 2nd day of August 1858 

made and executed by Hans Arneson of the County and State aforesaid to me 

to secure the sum of one hundred and twenty dollars and recorded in the 

office of the Register of Deeds of said County in Book E of Mortgages on 

page 352 on the 5th day of August aforesaid is paid in full.  Dated this 

2nd day of August A D 1860          Elias A Gray           seal

  On the second day of August A D 1860 before me came Elias A Gray to me 

known to be the individual described and who executed the above 

certificate and acknowledged that he executed the same
