All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/mn/mnfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Lil Heselton http://www.genrecords.net/emailregistry/vols/00004.html#0000855 March 1, 2009, 3:58 pm Source: Liber C P 55 Probate # 854 Mn Stearns County Probates 1883-1889 Written: December 25, 1880 The Last will and testament of Catherine Fredericks of Sauk Centre in the County of Stearns and State of Minnesota made this 25th day of December 1880 I Catherine Frederick considering the uncertainty of this mortal life and being of sound mind and memory do make and publish this my last will and testament in manner and form (that is today) first, I give and bequeath unto my daughter Rachel Post the undivided one fourth of all my many land and effects; second I give and bequeath unto my son Albert B Frederick the undivided one fourth and unto my daughter Harriet Cooper the same undivided one fourth and lastly I give and bequeath unto my daughter Polly Anne Ferrell the same undivided one fourth of all my property both real and personal. That is to say I give and bequeath unto the above named heirs all of my property both real and personal to be divided equally between them after paying all my legal debts and all my funeral expenses. I further give and devise unto Rachel Post, Albert B Frederick, Harriet Cooper and Polly Ann Ferrell and unto their heirs and assigns forever all my lands and tenements lying in the county of Pope and State of Minnesota to be equally divided between them. And lastly as to all the rest residue and reminder of my personal estate, lands chattels of what kind or nature favors it all to be equally divided between the above named heirs and lastly I hereby appoint my son Jacob Frederick the executor of this my last will and testament hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal this 25th day of December 1880. SaukCentre 2/21/84 Peter Frick, Judge of Probate Dear Sirs: I herunto return bound with notes of petition but I find that these will be bills of large account filed against the estate of Mrs Frederic Mrs Cooper informs me that she has had the active care of the deceased for almost two years up to the time of her death and that none of the other heirs would undertake the task and by agreement she should be paid and her bill over the amount of Division received will be over $500. dollars and then in addition to this Josiah Cooper held a mortgage on her land for $150.00 from ?????her soon after her husbands death this was payable at her death and given since ten years ago and drawing interest. Now Mrs Frederic was over 91 years old and for last two years as helpless as an infant being perfectly blind. And Mrs Cooper informs me that this is the reason that none of the rest of the heirs could take care of her. Permission for License to sell Real estate (part of above probate) State of Minnesota, county of Stearns In Probate Court, In the matter of Catherine Fredericks deceased. To the Judge of said court: The petition of Jacob S Fredericks, administrator respectfully represents that the total amount of personal estate that has come to his hands as such administrator is the sum of 500 dollars; that the said amount has been disposed of in paying the expenses of administration, the necessary funeral expenses, and a part of the debt of said deceased: that the debts now outstanding and unpaid against the estate of said deceased amount to about the sum of 700 dollars, as your petitioner believes, that the said deceased died seized of the following desceibed real estate, situate and lying in the County of Pope and State of Minnesota to wit: The South east ¼ of the south east ¼ of section 12, Township 126, Range 36 of the value of $200. The east half of the North East quarter and the south West quarter of the Northeast quarter of Section 13, Township 126, Range 36 of the value of $600. The names of persons interested in said estate and their addresses are as follows: Rachel Post, Turner, Orange county, NY Frank Frederick, Rockford, Minn Harriet Cooper, Sauk Centre, Minn Kate Northrup, Rockford Minn Ann Ferrell, Little Falls, Minn JS Frederick, Sauk Centre, Minn Sylvester Frederick, Rockford, Minn Francis W Frederick, Glenwood, Minn William Frederick, Rockford, Minn Charles Frederick, Rockford, Minn George Frederick, Rockford, Minn That it is necessary to sell all of said real estate in order to pay said debts and your petitioner would pray that license be to him granted to sell the whole of said real estate at public auction or probate court and he will ever pray.
