Township 120N R38 is Dublin - I don't have a map that shows the names of the other townships. Spelling and grammar errors are original and there are a couple places where I inserted __ because I was unable to decipher the handwriting and, in one spot, I included my best guess as to what the illegible word was. ***** This Indenture made this Fifteenth day of November A.D. one thousand eight hundred and seventy seven between Edmund Rice and Horace Thompson, two of the Trustees named in a Trust Deed, made by the First Division of the Saint Paul and Pacific Railroad Company, dated March 1st 1864, parties of the first part and Right Reverend John Ireland of the State of Minnesota, party of the second part, Witnesseth, that the said parties of the first part for and in Consideration of the sum of Fifteen Thousand and fifty six ($15,056.00) Dollars to them in hand paid by the said party of the second part, the reciept whereof is hereby acknowledged, have granted, bargained, sold, released, conveyed and confirmed, and do by these presents, Grant, Bargain, Sell, Release, Convey and Confirm, unto the said party of the second part, his heirs, successors and assigns, forever, all those tract or parcels of land situate, lying and being in the County of Swift in the State of Minnesota, known and described as follows, to wit: the West half (W 1/2) , the west half of the south East quarter (W 1/2 SE 1/4) and the South East quarter of the south East quarter (SE 1/4 SE 1/4) of Section thirty three (33), Town One Hundred and Twenty two (122) of Range Thirty nine (39), the South West quarter of the North West quarter (SW 1/4 NW 1/4) of Section Three (3) of the South half and the North East (S 1/2 & NE) quarter of Section Twenty one (21) all of section Thirty one (31) and the South East (SE) quarter of Section Thirty three (33), Town One Hundred and Twenty one (121) of Range Thirty eight (38) The south half (S 1/2) of Section Five (5) the South East (SE) quarter and the North East (NE) quarter of the South West (SW) quarter of Section Fifteen (15) Town One Hundred and Twenty (120) of Range Thirty eight (38), also the South East (SE) quarter of Section Thirty one (31) Town One Hundred and Twenty two (122) of Range Thirty eight (38) containing in all Two Thousand Four Hundred and Thirty six (2436) acres, more or less Reserving, however, a strip of land one hundred and fifty feet wide, to be used by the said Railroad Company for a right of way or other railroad purposes where the main line of its road, or any of its branches, as now located and constructed or hereafter to be constructed, is laid, or may pass over said premisses. The above described lands being a part of the lands granted to the late Territory and now State of Minnesota, by acts of Congress approved March 3d 1857, and March 3, 1865, for the purpose of aiding in the construction of a Railroad from Stillwater, by way of St Paul and St Anthony, to a point between the fort of Big Stone Lake and the mouth of the Sioux Wood River, with a branch, via St. Cloud and Crow Wing to the navigable waters of the Red River of the North. To have and to Hold the same together with all and singular, the heriditaments and appurtenances thereunto belonging, or in anywise appertaining unto said party of the second part, his heirs, successors and assigns, forever. And the said parties of the first part for themself and their successors do covenant with the said party of the second part, his heirs, executors, administrators and assigns, that they have not made, done, executed or suffered any act or thing whatsoever, whereby the above described premises, or any part thereof, now or at any time hereafter, shall or may be imperilled; charged or incumbered in any manner whatsoever, and the title to the above granted p__ises against all persons lawfully claiming the same from or under them, the said parties of the first part will Forever Warrant and Defend. – In Testimony whereof, the said Edmund Rice and Horace Thompson, Trustees, parties of the first part, have hereunto set their hands and affixed their seals, the day and year above [written?].
