Benton County, Missouri Wills - Asa McKinzie My last will and testament I want Margaret McKinzie my wife to take and have full possession of all my Estate with full power to settle said Estate without bond or probate for her own use and benefit as long as she remains my widow. Let Sarah and Asa retain their property I give them and give Margaret and Daniel a colt each, and David my son to have Two hundred & fifty dollars as his interest and at her death if any money or property left it is to be divided between my girls and James. John Asa & Daniel to have all my Real Estate to be divided equally between them but neither one of them shall ever at any time mortgage said land or sell to any person except to one another. T. Patten Judge and Clerk of the Probate Court held in and for the County of Benton and State of Missouri personally appeared John Holland and William G. Matthews who being duly sworn upon their oaths depose and say that they were present and saw Asa McKinzie sign by mark the foregoing instrument, purporting to be the last will and testament of him the said Asa McKinzie and heard him publish and declare the same to be his last will and testament and that at the time of signing the same the said Asa McKinzie was of sound and disposing mind and that these deponents subscribed their names thereto as witnesses to the same in the presence of the testation and of each other, and at the request of the said testation and that at the time of the signing of said will the said Asa McKinzie was over 21 years of age. Matthews subscribing witnesses thereto in relation to the execution of the same do declare and adjudge said instrument is the last will and testament of said Asa McKenzie deceased and the same is therefore admitted to probate.
