It is very poor quality with much of each page and entire pages being unreadable except for a word here or there.] Circuit Court of Butler County March Term 1852 Record of the proceedings of the Circuit Court began and held at the Court House in the Town of Poplar Bluff in Butler County in the state of Missouri on the first Friday after the second Monday of March AD 1852. Present the Hon Harrison Hough Judge of said court Friday the first day of the term and 12th day of the month. The sheriff returns into court the following Grand Jury to wit; James ______ who is appointed foreman, Samuel B. Remainder of page is largely unreadable.] Pages 12-13 Ordered that Cassias issue on all indictments found at this Term of the Court Ordered that court do now adjourn till six oclock tomorrow morning H Hough Court met pursuant to adjournment, present the same Judge as yesterday, Saturday the second day of the Term and 13th of the month Thomas Scott and others Heirs of Stephen Scott Decd Come and present their petition for the partition of lands herein after described & hereupon it appears from said petition That Thomas Scott, Exuus C. Scott, Hamilton Scott, Jesse F Scott, Joel Scott, Jane who intermarried with one Thomas Kirby, Charity who intermarried with one Harden Davis, Nancy who intermarried with one James Oliver, Rebecca who intermarried with one Charles Appleby, Fatimy who intermarried with one James Finly, are all the legal Heirs and representatives of the said Stephen Scott deceased. Said petition also prays for partition of the following land to wit; the south East quarter of the northwest quarter of section sixteen township twenty five range five east containing forty acres. Also the south east quarter of the southwest quarter of section sixteen township twenty five range five east containing forty acres, All which lands being lying and situate in the County of Butler and State of Missouri. Whereupon the Court being satisfied from the evidence in the cause, that the said Lands as described in said petition are situate in the county of Butler and State of Missouri, And that the said Stephen Scott died seised and possessed of the same as also that the said Heirs as herein named are all the Heirs of the said Stephen Scott Deceased and that they are entitled each as set forth in said petition to the one undivided tenth part of said real estate, the Court also being satisfied from the evidence in the cause that said real estate cannot be partitioned amongst said Heirs, without great prejudice to the interest of said heirs it is therefore ordered and adjudged that said real estate be sold and on the following terms to wit; One tenth of the purchase money to be paid down and the balance nine tenths on a credit of twelve months, With note and good security, and that the proce___ of the sale of said real estate be distributed to the aforesaid heirs according to their respective rights aforesaid.
