Phelon, Frank - In June, 1886 a prosecution was commenced against David A. Burnes for the murder of Frank Phelon. The case was continued from time to time until August 19, 1887, when the prisoner, having been apprehended, was arraigned for trial and plead "not guilty." Out of forty men summoned for the purpose, a jury of twelve was impaneled, before whom the prisoner was tried, and by whom the following verdict was rendered: "We, the jury, find the defendant guilty of murder in the second degree, and assess his punishment at imprisonment in the State Penitentiary during his natural life."
