Whereas on the 14th day of March in the year of our Lord one thousand eight hundred & Sixty seven the Probate Court of the county of Cedar in the State of Missouri, at the March term 1867 of said Court ordered by an entry of record that I as Administrator of said Estate sell at probate sale for cash in hand the following described real estate of said deceased to wit - The south West qr of the South West quarter of Section thirteen (13) township Thirty four (34) of Range Twenty six (26) West situate in said county of Cedar or so much thereof as may be necessary to pay the debts of said Estate, and whereas previously to the time of my selling said real estate as hereinafter mentioned I as such administrator had said Real Estate appraised in due form of law by Riley Sherrill, Thomas Smith and Thomas H. Sutherland, three disinterested householders of said County who on the 6th day of April A.D. 1867 after having first made the affidavit required by law, appraised said real estate to be of the value of Two hundred Dollars and so certified in their certificate of appraisement; by virtue of which said Order of Sale and appraisement, and the power in me by law vested so to do, I as such Administrator did at divers times & places make diligent efforts to sell the said real estate at private sale, and on the 2nd day of September A.D. 1867, I did Sell the said real Estate to Jeremiah R. Owen he having made me the highest and best bid & offer for the same at & for the price & sum of Three hundred Dollars, And Whereas at the term of the Probate Court of said County of Cedar next following the sale of said real estate being the September term 1867, I as such administrator made to said Court a report verified by my affidavit as the law directs and accompanied by the certificate of appraisement, and with a full account of my proceeding touching said sale, all as heretofore set forth & including the manner, time, terms and place of sale, and the property sold and to whom sold, and which report was thereupon approved by said court by its proper order entered of record, Now therefore in consideration of the premises and of the said sum of Three hundred dollars to me said Administrator paid by the said Jeremiah R. Owen (the receipt whereof I do hereby acknowledge) and by virtue of the authority in me vested by law so to do, I Harrison Swingle Administrator as aforesaid do hereby grant, sell and convey to the said Jeremiah R. Owen, all the right, title & interest which the said John Swingle deceased had of, in and to said real estate at the time of his death, To have & to hold the right title & interest hereby conveyed unto the said Jeremiah R. Owen his heirs & assigns forever. In witness whereof I Harrison Swingle Administrator as aforesaid have hereto subscribed my name, and affixed my seal this 17th day of October A.D. 1867. Be it remembered that on this the 17th day of October A.D. 1867, Harrison Swingle administrator of the estate of John Swingle deceased who is personally known to the undersigned Judge of the Probate Court within & for said County to be the person & officer whose name is subscribed to the within & foregoing deed as a party thereto this day appeared before me and acknowledged that he executed and delivered the same as his voluntary act and deed for the uses & purposes therein contained.
