Evans, Chariton County The State of Missouri Chariton County March the fifth (5) and the year of our Lord one thousand eight hundred and seventy two (1872); through the good providence of God I this day enjoy the right reason of mind, therefore to all to whom it may concern, that I this day in view of the uncertainty of Life and the surity of Death make this my will and Testament. I therefore appoint Nancy Evans my wife to be my administratix to settle up the Estate and pay off the Liabilities against the same and further I give and bequeath unto the said Nancy Evans my wife all of the personal and real Estate to have and to hold during her life to sell and convey and to use the same to the best posible advantage for her own comfort and the good of the Estate so long as she remains my widow, and, no longer is this right invested in the management of said Estate. Should she remain my widow till Death then the Estate is to be valued and the said Nancy Evans my wife if she desires so to do can keep one third of said Estate to give to whom she will the other two thirds to be divided among the heirs to said Estate, with this proviso strictly adhered to which is as follows to (wit) that any help or means that I receive from any of the heirs to said Estate during Life they are to realise to their benifit over and above their Equal part of said Estate. I advise no division of said Estate before the Death of my administratrix without the mutual consent of all the parties concerned therein; In testimony of said will I William M. Smith, Judge of the Probate Court in and for the County and State aforesaid William Recob and Henry Kelso, the subscribing witnesses to the annexed will of William M. Evans, and, being by me first duly sworn, depose and say that the said William M. Evans, the testator, subscribed the same in their presence, and published the said will or instrument of writing as his last will; that the said testator was, at the time of publishing his said will, of sound mind, and more than twenty-one years of age, and that they, the said deponents, attested the said will as witnesses thereto by subscribing their names to the same in the presence of said testator. Smith, Judge of the probate court in and for said county of Chariton having examined the foregoing instrument purporting to be the last will and testament of William M. Evans deceased and signed by the said William M. Evans deceased late of Chariton Co., Mo., and having heard the testimony of William C. Recob and Henry Kelso, the subscribing witnesses to the same in relation to the execution of the same do adjudge it to be the last will and testament of the said William M. Smith Judge of Probate Recorded on page 54 ---------------------- Bond of Executor We, Nancy Evans, as principal, and [blank] and [blank] as securities, are held and bound to the State of Missouri in the sum of Two Thousand Dollars, for the payment of which we bind ourselves, our heirs, executors, and administrators. The condition of the above bond is that if Nancy Evans the Executrix of the last will and testament of William M. Evans, deceased, shall faithfully execute the said will, account for, pay and deliver all money and property of the deceased, according to the provisions of said will, and perform all other things touching such executorship required by law or the order or decree of any court having jurisdiction then the above to be void; otherwise to remain in full force. Evans, deceased, William Recob and Henry Kelso are appointed witnesses to assist in making an inventory of said estate. In Testimony Whereof, I, O.F. Smith, Judge of the Probate Court of Chariton County, hereto sign my name and affix the seal of said Court, at office this 18 day of April A.D. 1872. O.F. Evans, deceased, are hereby notified that at the next July term of the Chariton county Probate Court, to be begun and held in the town of Keytesville, on the 2nd Monday in July, A.D. 1873, I shall make final settlement of said estate.
