Written: September 17, 1927 Recorded: September 20, 1927 TO ALL TO WHOM THESE PRESENT SHALL COME: I, J. N. Derksen Sheriff of Clark County, in the State of Missouri, send Greeting: KNOWE YE, That whereas, at the August Term 1927, of the Circuit Court of the County of Clark in a certain suit then pending in said Court wherein Edward E. Eggestein, Mary M. Eggestein and Anna D. Draper were Petitioners, against Nellie E. Eggestein, Ethel Louise Eggestein and Eston Eugene Eggestein Defendants, for the Partition of the following described Real Estate, situate, lying and being in the County of Clark and State of Missouri, descending to them as hers and legal representatives of Henry Eggestein deceased, to-wit: Lot one (1) of Block Thirty Eight (38) of First Addition to the town of Wyaconda, Clark County, Missouri. The said Court then and there decreed, that Partition of said land be made among the parties, according to their respective interest, and it appearing to said Court that said land could not be divided in kind amongst the parties therein, it was thereupon ordered and decreed by said Court, that the Sheriff of said County of Clark proceed to advertise and sell the same according to law; all of which facts and Orders of Court fully appear from the records of said Circuit Court. AND WHEREAS, A certified copy of said Order of Sale was duly made out by the Clerk of said Court, and to me, the said Sheriff, dated August 3, 1927. AND WHEREAS, In obedience to said Order of Sale, I, the said Sheriff, did cause the said Real Estate to be advertised for sale for a period of twenty days, next day of before the sale thereof, by advertisement in the Wyaconda Leader, a newspaper printed and published in said County of Clark containing a particular description of the Real Estate to be sold, and stating the time, place and terms of sale. AND WHEREAS, in obedience and conformity to said Order of Sale and advertisement aforesaid, I, the said Sheriff of said County, did on the 17 day of September 1927, at the August Term of the Circuit Court for the year 1927 and while said Court was in session, between the hours of nine o’clock in the forenoon and five o’clock in the afternoon of that day, proceed to offer and expose to sale, at public auction, to the highest bidder, on the following terms, viz: Cash in hand at the Court House door, in the City of Kahoka in said County of Clark the Real Estate above described; and having so offered and exposed the same for sale for a long space of time as aforesaid, and Lucy Hartman being the best highest and last bidder … for the following described Real Estate, became the purchaser … thereof, for the price and sum of Thirteen Hundred five Dollars and No Cents, to-wit: Lot One (1) of Block Thirty Eight (38) of First Addition to the town of Wyaconda, Clark County, Missouri. AND WHEREAS, the said Lucy Hartman has fully paid and satisfied to me the full amount of money by her did as aforesaid, for said last described Real Estate. NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, That I, J. N. Derksen Sheriff of Clark County, in the State of Missouri, for and in consideration of the premises, and of said sum of Thirteen Hundred five and No/100 Dollars, to me in hand paid, do Assign, Transfer and Convey, and set over, unto the said Lucy Hartman her heirs and assigns, the Real Estate last above described, TO HAVE AND TO HOLD THE SAME, with the appurtenances, unto her the said Lucy Hartman heirs and assigns, forever, as fully and effectually as I, the said Sheriff of said County, by the power and authority in me vested in the premises, as such, can sell and convey the same. IN TESTIMONY WHEREOF, I the said Sheriff, have hereunto subscribed my name and affixed my seal, this 17 day of September 1927. J. N. Derksen {Seal} Sheriff. STATE OF MISSOURI, County of Clark}ss. IN RHE CIRCUIT COURT, August Term, A.D. 1927. BE IT REMEMBERED, That on this 17 day of September in the year of our Lord, 1927 before the Hon. Walter A. Higbee Judge of the Circuit Court, within and for the County aforesaid, came into open Court, J. N. Derksen personally known to the said Judge to be the same person whose name is subscribed to the foregoing instrument of writing, as having executed the same, and also known to be the Sheriff of the County of Clark aforesaid, and then and there, in open court, before the said Judge acknowledged the said instrument to be his act and deed, for the purposes therein mentioned, this Certificate of Acknowledgment being ordered by the said Court to be endorsed by the Clerk on this Deed. IN TESTIMORE WHEREOF, I Harry H. Lewis Clerk of our said Court, have hereunto set my hand and affixed the seal of said Court. Done at my office in Kahoka, Missouri, in the County aforesaid. By D.C.
