I give and bequeth to my belove wife Isabel Pollock one third of all my Estate Real personal and mixes after the payment of all my Inst debts. 2nd. I give and bequeath to my daughter Rachel One hundred dollars including her Bed and bedding. 3rd. having purchased a lot of cattle for which I am now indebted and which (cattle) are nearly ready for market I will and desire that they be Sold as soon as practicable and the amount I owe for them be paid out of the proceeds of the sale. 4th. I will and bequeath to my wife provisions Sufficient for my family for one year out of what are now on hand. 5th. I will and devise and empower my Executors hereinafter appointed that whenever they deem it to the interest of my Heirs to make sale of my farm and all my real Estate and that the proceeds thereof be invested by my executors as may to them seem for the best interest of my heirs and that the amount hereinafter devised to each of them be paid to them on their arriving at the age of twenty one years or the girls on their marriage. 6th. I will and desire that after the bequests heretofore made be paid that all the remainder of my Estate be devided Equally between all my children. 7th. I hereby appoint my Wife Isabel Pollock my son William Pollock and my Friend Thomas Cherry Executors of this my last Will and Testament. On Testimony where of I hereto Subscribe my name and affix my seal the 22nd day of February AD 1860 John Pollock [seal] Signed and declared by the above named John Pollock to be his last Will and Testement in the presence of us who at his request and in his presence have Subscribed our names as witnesses thereto C Sehew James H Crane State of Missouri } County of Clark } Be it remembered that on this 2nd day of March 1860 personally appeared before the undersigned clerk of the county court of the County of Clark as aforesaid C Sehew and James H Crane the Subscribing witnesses to the annexed will of John Pollock deceased and being by me first duly sworn depose and say that the said John Pollock the testator subscribed the same in their presence and published the said will or instrument of writing as his last will that the said testrtor was at the time of publishing his said will of Sound mind and that they the said deponents attested the said will as witnesses thereto by subscribing their names to the same in the presence of said testator and at the request of said testator. Subscribed and sworn to before } C Sehew me this 2nd day of } March 1860 } James H Crane In testimony whereof I hereunto Subscribe my name and affix the seal of said court this day and date above written John Langford Clerk Filed March 2nd, 1860 John Langford Clerk Know all men by these presents that we Thomas Cherry and William Pollock as principal and W J Pierce and John Z Harbin as Securities are held and firmly bound to the State of Missouri in the Sum of Ten thousand Dollars for the payment of which we bind ourselves our heirs executors and Administrators. The condition of the above Bond is that if Thomas Cherry and William Pollock the Executors of the last will of John Pollock deceased Shall faithfully execute the said will ace.... for pay and deliver all money and property of the deceased according to the provisions of said will and perform all other things touching such executorship required by law or the order or decree of anyCourt having jurisdiction then the above bond to be void Otherwise to remain in full force. Know Ye that the last will of John Pollock deceased hath in due form of law been exhibied proved and recorded in the office of the Clerk of the County Court for Clark County a copy of which is hereto annexed. And in as much as it appears that Thomas Cherry and William Pollock have been appointed Executors in and by the said last will to execute the same and to the end that the property of the Testator may be preserved for those who shall appear to have a legal right or interest therein and that the said last will may be Executed according to the Request (?) of the Testator, We do hereby authorize them the said Thomas Cherry and William Pollock as such Executors to collect and secure all and singular the goods and chattels rights and credits which were or the said John Pollock at the time on his death in whosever possession the same my be found. And to perform and fulfill all such duties as may be enjoined upon them by said will so far as there shall be property and the law charge them.
