This indenture made and entered into this 19th day of July in the year of Our Lord One Thousand Eight Hundred and forty five between John Cruse & Margaret his wife of the County of Clay and State of Missouri of the one part and Thomas Peebly of the County of Clay and State aforesaid of the other part Witnesseth that the said John Cruse and Margaret his wife for and in consideration of the sum of One hundred fifty Dollars to them in hand paid the receipt whereof is severally acknowledged do hereby grant Bargain sell Alien Convey and Confirm unto the said Thomas Peebly his heirs and assigns forever, all that tract or parcel of land situated and being in the county of Clay and State of Missouri Being the West half of the North East quarter of Section Ten in Township fifty one North of the Missouri river of Range thirty in the District of lands subject to sale at Lexington Missouri containing Eighty acres more or less Together with all the and singularly the appurtenances thereunto belonging or in any wise appertaining. To have and to hold the above described premises unto the said Thomas Peebly his heirs and assigns forever And the said John Cruse and Margaret his wife the aforesaid premises premises unto said Thomas Peebly and his heirs and assigns against all manner of claims or claims of all and every person whomsoever and will warrant and defend by these presents. In Witness whereof the said John Cruse & Margaret his wife of the first-part have hereunto set their hands and seals the day and year above written John Cruse Margaret Cruse State of Missouri County of Clay Be it remembered that on this 19th day of July A.D. 1845 appeared before me Wm Heutt one of the Justices of the Peace of Fishing River Township in the County of Clay and State of Missouri John Cruse and Margaret his wife who are personally known to me to be the persons whose names are subscribed to the foregoing instrument of writing as having executed the same and severally acknowledged the said instrument to be their act and deed for the purpose therein mentioned she the said Margaret Cruse being by me examined separately and apart from her said husband whether she executed the said instrument voluntarily freely and without compulsion or undue influence of her said husband acknowledged and declared that she executed the said instrument voluntarily freely and without compulsion or undue influence of the said Husband.
