This Indenture made on the 29th day of April A.D. one thousand eight hundred and sixty seven by and between Absalom Cruse and Didama Cruse of the County of Ray & State of Missouri parties of the First Part, and Benedict J. Yates of the County of Clay in the State of Missouri party of the Second Part. WITNESSETH, That the said parties of the first part, in consideration of the sum of Two Hundred Dollars, paid by said party of the second part, the receipt of which is hereby acknowledged, do, by these presents, Grant, Bargain and Sell, Convey and Confirm, unto the said party of the Second Part, his heirs and assigns, the following described Lots, Tracts or Parcels of Land, lying, being, and situate in the County of Clay and State of Missouri to-wit: ALL one undivided sixth part (more or less) in and to the North East quarter of the South East quarter of Section No. Eleven (11) in Township No. fifty one (51) of Range No. Thirty (30), also the South West quarter of the South West quarter of the same Section Township and Range also the South East quarter of the South West quarter of same Section Township and Range, containing in all one hundred & thirty acres more or less being the lands assigned to their mother Margaret Yates (formerly Jackson), for life, by a decree of the Clay Circuit Court July 28th A.D. 1857 as by reference to the records will appear, the parties of the first part the said Absalom Cruse and his wife Didama Cruse to Convey to the party of the second part whatever interest they may have in the dower of lands aforesaid, assigned to his mother by such decree, they as one of the heirs of said Cruse deceased awarding one undivided sixth by such decree they as one of the heirs of said John Cruse deceased TO HAVE AND TO HOLD the premises aforesaid, with all and singular the Rights, Privileges, Appurtenances and Immunities thereto belonging, or in anywise appertaining, unto the said party of the second part, and unto his heirs and assigns FOREVER; the said Absalom Cruse and his wife Didama Cruse hereby convenanting that they lawfully seized of an indefeasible Estate in fee, in the premises herein conveyed; that they have good right to convey the same; that the said premises are free and clear of any encumbrances done or suffered by them or those under whom they claim; and that they will WARRANT AND DEFEND the title to the said premises unto the said party of the second part, and unto his heirs and assigns FOREVER, against the lawful claims and demands of all persons whomsoever. IN WITNESS WHEREOF, The said parties of the first part, have hereunto set their hands and seals the day and year first above written Absalom Cruse Didama Cruse State of Missouri County of Clay Be it remembered that on this 29th day of February A.D. 1867, before the undersigned, a Justice of the Peace, within and for the County of Clay and State of Missouri personally came Absalom Cruse and his wife Didama Cruse who are personally known to me to be the same persons whose names are subscribed to the foregoing instrument of writing, as parties thereto, and acknowledged the same to be their act and deed, for the purposes therein mentioned. And the said Didama Cruse, being by me first made acquainted with the contents of said instrument, upon an examination separate and apart from her husband, acknowledged that she executed the same, and relinquishes her Dower in the Real Estate therein mentioned, freely and without fear, compulsion, or undue influence of her said husband.
