Reid, 2006 This Indenture made and entered into this fourth day of February in the year of our Lord one thousand eight hundred and sixty-three by and between Tolbert N. OBryant and Eliza OBryant, his wife, of the County of Ray and State of Missouri of the first part and Samuel Cruise Henry Cruise and John Cruise of the County of Clay and State of Missouri of the second part, Witnesseth that said party of the first part, for and in consideration of the sum of Seven hundred and fifty Dollars to them in hand paid, the receipt whereof is hereby acknowledged, have Given, Granted, Bargained and sold and by these presents do Give, Grant, Bargain, sell , alien, convey and confirm unto said party of the second part, and to their heirs and assigns forever, a certain tract piece or parcel of Land lying and being in the County of Clay and State of Missouri viz: The south East quarter of the South East quarter of Section Ten of Township fifty one of Range Thirty containing forty acres more or less. To have and to hold the said tract piece or parcel of land with all the appurtenances thereunto belonging or in any wise appertaining to the only proper use, benefit and behoof of them the said party of the second part and to their heirs and assigns forever and the said party of the first part, for themselves heirs executors and administrators, covenant and agree to and with the said party of the second part and to their heirs and assigns the said tract piece or parcel of Land and bargained premises every part and parcel thereof unto the said party of the second part and to their heirs and assigns against all manner of claim will warrant and forever defend the same by these presents. In Witness whereof Tolbert N. OBryant and Eliza OBryant his wife, partys of the first part have hereunto set their hands and seals the day and year above written. Tolbert N. OBryant Eliza OBryant State of Missouri County of Clay Be it remembered that on this twenty third day of February in the year of our Lord One thousand Eight Hundred and Sixty Three before me James Reed a Justice of the peace , within and for the County aforesaid personally appeared Tolbert N. OBryant and Eliza OBryant his wife who are personally known to me to be the persons whose names are subscribed to the within and foregoing Deed as having executed the same as party thereto and acknowledged the same to be their act and deed for the purpose therein mentioned. She the said Eliza OBryant the wife of Tolbert N. OBryant being by me first made acquainted with the contents thereof and examined separate and apart from her husband, whether she executed the said instrument of writing freely and without compulsion or undue influence of her said husband acknowledged and declared that she executed the said deed and relinquishes her Dower in the said lands and tenements therein mentioned, voluntarily freely and without compulsion, or undue influence of her said husband.
