Stothart of the County of Clay and State of Missouri of the first part and John Cruse of the county of Clay and State aforesaid of the second part. Witnesseth that the said party of the first part for and in consideration of the sum of four hundred dollars to him in hand paid the receipt whereof is hereby acknowledged have given granted bargained and sold and by these presents doth give grant bargain sell alien convey and confirm unto the said party of the second part and to his heirs and assigns forever a certain tract piece or parcel of land lying and being in the County of Clay and State of Missouri. VIZ. The West half of the south west quarter of section twelve in Township fifty one and Range thirty (N.M.) containing as per governmental survey eighty acres. To have and to hold said tract piece or parcel of land with all the appurtenances thereunto belonging or in any wise appertaining to the only proper use benefit and behoof of him the said party of the second part and his heirs and assigns forever and the said party of the first part for themselves their heirs executors and administrators covenant and agree to and with the said party of the second part and his heirs and assigns that the said tract piece or parcel of land and bargained premises and every part and part thereof unto him the said party of the second part and to his heirs and assigns against all manner of claims he will Warrant and forever defend the same by these presents. In Witness Whereof the said John D. Stothart of the first part has hereunto set his hand and seal the day and year above written. John d. Stothart State of Missouri County of Clay Be it remembered that on this 20th day of November A D 1839 before me Samuel Tillery clerk of the Circuit Court within and for the county aforesaid appeared John d. Stothart who is personally known to me to be the person whose name is subscribed to the within and foregoing instrument of writing as having executed the same as a party thereto and acknowledged the said deed to be his act and deed for the purposes therein mentioned. In witness where I have hereunto set my hand and affixed the seal of said court the day and date first above written.
