This Indenture made and entered into this 31st day of October in the year of 
our Lord one thousand eight hundred and sixty-six by and between Benedict Yates 
& Margaret Yates, his wife, of the County of Clay and State of Missouri of the 
first part and Joseph Davis of the County of Clay and State of Missouri of the 
second part, Witnesseth
	That said party of the first part, for and in consideration of the sum 
of Eight hundred Dollars to them in hand paid, the receipt whereof is hereby 
acknowledged, have Given, Granted, Bargained and sold and by these presents do 
Give, Grant, Bargain, sell , Alien, Convey and Confirm unto said party of the 
second part, and to his heirs and assigns forever, a certain tract piece or 
parcel of Land lying and being in the County of Clay and State of Missouri viz:
	Forty Eight and one half acres off the South end of the East half of 
the south West quarter in Section Eight in Township Fifty Two, Range thirty 
One, except Ten acres to be taken out of the North East corner of ___ of said 
tract, it being the same land purchased by Elisha Higbee of the administrators 
of the estate of James Newbee, The said Ten Acres in an oblong shape commencing 
at the S.E. Corner of said East half of S.W. ¼ Section 8 T 52, R 31, thence 
swerving a North West direction so as to include the Ten acres excepted in this 
deed  the balance of Thirty eight acres and one half is the amount intended to 
be conveyed in the deed.  
	To have and to hold the said tract piece or parcel of land with all the 
appurtances thereunto belonging or in any wise appertaining to the only proper 
use, benefit and behoof of him the said party of the second part and to his 
heirs and assigns forever and the said party of the first part, for themselves 
& their executors and administrators, covenant and agree to and with the said 
party of the second part and to his heirs and assigns the said tract piece or 
parcel of Land and bargained premises every part and parcel thereof unto the 
said party of the second part and the his heirs and assigns against all manner 
of claim will warrant and forever defend the same by these presents.  
	In Witness Whereof Benedict Yates and Margaret Yates his wife, parties 
of the first part have hereunto set their hands and seals the day and year 
above written.
