In the Clay Circuit Court, October Term, A.D. 1856 Tucker M. Jackson, Margaret Jackson, his wife, formerly Cruze, widow of John Cruz, deceased; Henry J. Wright and Sarah Wright his wife, formarly Sarah Cruze; and Eli Jackson and Susannah Jackson his wife, formerly Susannah Cruze, Plaintiffs. Against Absalom Cruze, Henry Cruze, Samuel S. Cruze, and John Cruze, minor children of John Cruze, deceased; and Isaac Brown, as administrator of the estate of John Cruze deceased, Defendants. Now at this day comes the Plaintiffs, by their attornies, and it appearing that the defendant Henry Cruze, cannot be summoned in this action; It is ordered by the court that publication be made notifying him that an action has been commenced against him by petition in the circuit court of Clay county, in the State of Missouri, the object and general nature of which is for dower and partition of certain real estate lying and being in said county of Clay, and unless he be and appear at the next term of this court to be holden at the court house in the city of Liberty, in the county of Clay, on the 27th day of April, A.D. 1857, and on or before the third day thereof, (if the term shall so long continue, an if not then before the end of the term) judgment will be rendered against him in conformity with the prayer of the petition. It is further ordered that a copy hereof be published in the Liberty Weekly Tribune, a newspaper published in the county of Clay for four weeks successively, the last insertion to be at least four weeks before the commencement of the next term of this court, and this cause is continued.
