Deed Book D, P. 487 Written: November 19, 1835 Recorded: December 25, 1835 Know all men by these presents, that I William Givens of the County of Fleming and Commonwealth of Kentucky have made, nominated and appointed and by these presents do make, nominate and appoint my son John Givens of Cooper County and State of Missouri my true and lawful attorney for me and in my name and for my use and benefit to ask, demand, sue for recover, receive of and from the executors and administrators or other person or persons lawfully authorize to make distribution of the estate of my father Alexander Givens, late of Cooper County and State of Missouri, dec., also of my brother James Givens, late of Cooper County and State aforesaid, dec., all such sum or sums of money, goods, chatteles and credits as are due owing to or coming to me the said William Givens as one of the heirs of the said Alexander Givens,dec., and James Givens, dec., and to have use and take all lawful ways and means in my name or otherwise for the recovery thereof and to compound and extract and agree for the same and acquaintances or other sufficient discharges for the same for me and in my name to make, seal, and deliver and to do all lawful acts and things whatever concerning the premises as fully and in every respect as I myself might or could do were I personally present ratifying and confirming and by these presents allowing whatever my said attorney shall lawfully do in and about these presents. In Witness wereof I have hereunto my hands and affixed my seal this 19th day of November 1835 William Givens seal Fleming County This day personally appeared before the undersigned two of the Commonweatlth Justices of the Peace for the county aforesaid William Givens and acknowledged the written power of attorney to John Givens for the purposes within mentioned to be, act and given under my hand and seals this 19th day of November 1835. Joseph C. Belt seal Wilson P. Boyd seal Fleming County I Joshua Stockton, clerk of the Court for the county aforesaid certify that Joseph C. Belt and Wilson P. Boyd, esquires before whom the foregoing letter of attorney from William Givens to John Givens appears to have been acknowledged and who have here unto subscribes their names thereto and were at the time of subscribing their names there to two of the Justices of the Peace in and for the county and state aforesaid duly and legally commissions and invoices and that all certificates of them given as such due faith and credit is and right to be given as well in courts of justice as then court in testimony whereof I have hereunto set my hands and affix the seal of said count at Flemingsburgh the 19th day of November 1835 seal Joshua Stockton Fleming Co. Clark Additional Comments: The James Givens mentioned in deed as son of Alexander Givens and brother to William Givens owned 160 acres of land in Section 21, Twsp. 48, Range 15. And entry in 1835 Tax List of Cooper Co., Mo. lists heirs as paying taxes on land. James is not named in his father Alexander Givens' will which is found in Cooper Co., Mo. Will Book A, p. 62. The will was recorded around 1833 but was written 16 Aug. 1821. Therefore, an assumption is made that James died around 1820 as his wife re-married in 1821. For the other children of Alexander Givens see his will. His other children are named in the will. I have a zerox copy of the above record plus the will in my possession.
