State of Missouri                In the Probate Court
County of Daviess                   In vacation

Be it remembered that in vacation of the Probate Court of said county on this 
the 22nd day of December A.D. 1874 among other proceedings had were the 
following to wit:

                IN VACATION--December 22, 1874

In the matter of the Estates of Martha A. Givens, et al, minors

    Now at this day it having come to the knowledge of the undersigned Judge 
of the Probate Court that Merrit Givens, Jr. and John W. Givens minor heirs of 
Merrit Givens, dec'd late of Daviess Co., Mo. over the age of fourteen years 
and without a Guardian or Curator and said minors coming before the 
undersigned and choosing Nancy Talbot as their Guardian & Curator , and the 
choice so made is considered a good one, and Mary E. and Martha A. Givens 
being under the age of fourteen years, the undersigned hereby appoint the said 
Nancy Talbot Guardian & Curator of said Mary E. and Martha A. Givens together 
with the first named minors: all the above named minors being residents of 
Daviess County, Missouri:  It is therefore ordered that the said Nancy Talbot 
be appointed Guardian & Curator of all the above named minors, that she enter 
into bond to the state of Missouri in the sum of two thousand dollars, 
conditional according to law.  And now here comes said Nancy Talbot and files 
here her bond in said sum of Two Thousand Dollars with Isaac Givens and Levi 
M. Mullins as her securities, which said bond is approved and said Guardian 
and Curator is ordered to enter upon the discharge of ther duties at once.

Which said bond is in the woods and figures following to wit:

Know all men by these presents:
   That we Nancy Talbot as principal and Isaac Givens and Levi M. Mullins as 
securities are held and firmly bound into the state of Missouri in the sum of 
Two Thousand dollars, for the use of Meritt Givens, Jr. and John W. Givens 
over the age of fourteen year: and Mary E. Givens and Martha A. Givens under 
the age of fourteen years all minor heirs of Merrit Givens deceased, late of 
Daviess County Missouri, for the payment of which we bind ourselves, our 
heirs, executors and Administrators, firmly by these presents, sealed with our 
seal and dated this 22nd day of Dec'r A.D. 1874.  The condition of the above 
bond is that if Nancy Talbot shall faithfully discharge all her duies as 
Guardian & Curator of said minors, according to law, then this bond is to be 
void, otherwise to remain in full force and virture:  Witness our hands and 
seals, the day and year aforesaid.

I Henry C. McDougal, Judge of the Probate Court within and for the county and 
state aforesaid hereby certify the within and foregoing to be a full, true and 
correct copy of an order appointing Nancy Talbot, Guardian and Curator of 
Martha A. Givens and other minors as fully as the same remains of record in my 
office together with a copy of the bond given by said Nancy Talbot as such 
Guardian and Curator as fully as the same remains of record and on file in my 
said office.
     In testimony whereof I have hereunto set my hand and affixed the seal of 
said court, done at office in the City of Gallatin, this 23rd day of 
Decembered A.D. 1874.

Additional Comments:
After her husband Merrit Givens' death, Nancy Givens married Joshua Talbott on 
4 Oct. 1869 found in Daviess Co., Marriage Book D, p. 24 at the courthouse at 
Gallatin, Mo.  Joshua Talbott later deserted her and her children by Merrit 
Givens.  Above children mentioned in court record are her minor children.  
Nancy and Merrit had older children as well.  Securities for the bond were as 
mentioned Isaac Givens and Levi Mullins. Isaac Givens was her son, and Levi M. 
Mullins was the husband of her neice.  This record is found in Nancy's Civil 
War Pension Record.  Probate records can only be found after 1890 at the 
courthouse.  Probate records before 1890 were destroyed due to a fire at the 
courthouse, I was told.
