Box 16 April 1855 Written: 1854 Recorded: May 19, 1854 William Splawn, et al vs. Mary Splawn and Jonathan Splawn Petition for the Partition of the Estate of Isaac Splawn, Sr., deceased In the Circuit Court of Daviess Co., Mo. Plaintiffs state that Isaac Splawn, Sr., decd., late of Daviess Co., Missouri departed this life in A.D. 1853 seized and possessed of certain land and personal estate--that the personal estate of said deceased is amply sufficient to satisfy all debts and liabilities of said estate. That the said deceased estate was seized in fee of the following described real estate situated in the Co. of Daviess and State of Missouri to wit: the west half of the northeast quarter and the east half of the northwest quarter and the west half of the southeast quarter all in section number twenty-five of township 58 of range 28, containing 240 acres-- also lot no. 6 in block 3 west to 4 south in the town of Gallatin, fronts 46 & 2/3 ft.--and rear back 115 ft. That the said Martha intermarried with William Splawn and Sebrina intermarried with Richard Wooderson and Lucinda intermarried with John McCrary, are daughters of the deceased--that the said Jonathan Splawn and John Splawn are the said sons of the deceased--that the sons and daughters are the only legal heirs of said deceased and tenants in common in said land, and each petition in court of the said Mary Splawn who is the widow of the said deceased Plaintiffs may for a division and partition of said land and for the administerance of dower to the said widow according to the respective rights of the parties interested and for a sale thereof if it shall appear that partition cannot be made without great preference to the successors. Plaintiffs further state that the above and foregoing sells forth the rights and titles of all parties interested therein so far as the same one known to your partitioners, including for tenants for years for life, by the courtesy as in dower and of persons entitled to the reversions, remainders, or inheritances, and of every person who upon any contingency may be or become entitled to any beneficial interest in the premises. May 19, 1954 Thomas T. Frame Clerk Additional Comments: Mary Splawn, named above as the widow of Isaac Splawn, was his 2nd wife, and step-mother to Isaac's children named in this petition. They brought the suit against her for the partition of their father's land. Isaac Splawn was one of the first settlers of Daviess Co., Mo., coming to Daviess Co. from Bedford Co., Tn. in the late 1830s (then Ray Co.). Isaac was originally from South Carolina. There are many other court records in this file box related to Isaac's estate and the partitioning of the land. This is the most important record in the file box as it gives Isaac's death date and names his children who are his heirs as stated above. Isaac Splawn and his first wife Elizabeth Wood are my great-great-great-grandparents.
