Deed Book 135, p. 374 This indenture made on the 15th day of August A.D., one thousand nine-hundred and twenty-eight by and between Myrtle Givens and Walter Givens, her husband, of Baker County, State of Oregon; Effie Scott and Alfred Scott, her husband, of Caldwell County, State of Missouri, parties of the first part and Virgil E. Givens and Katie E. Givens, the County of Caldwell, State of Missouri, parties of the second part. Witnesseth that the said parties of the first part, in consideration of the sum of nine-hundred dollars to them paid by the parties of the second part, the receipt of which is hereby acknowledged do by these presents, grant, bargain, and will convey and confirm unto the said parties of the second part, their heirs and assigns, the following described lots, tracts or parcels of land, lying, being, and situated in the County of Daviess and State of Missouri, to wit: All of an undivided one half of, in and to the following to wit: The Southeast quarter of the Southwest quarter of Section Twenty (20), being forty acres, more or less, and all that part of the Northeast quarter of the Northwest quarter of section twenty-nine (29), which lies North of the center line of Marrowbone Creek, being twenty-five acres, more or less; all being in Township fifty-eight (58) of frange twenty-eight (28); The said Katie E. Givens is the widow of Isaac Givens, who died in the year 1915, the owner of said real estate, and the said Myrtle Givens, Effie Scott and Virgil E. Givens are the children of said Isaac Givens, deceased; the said Isaac Givens having left surviving him no child or descendents of a deceased child other than those herein named; said Isaac Givens having died intestate, and said Katie E. Givens having taken a child's part in the estate of her deceased husband; it being the intention to convey to and vest in the grantee herein all right, title, interest and estate of the grantors herein; in and to the above described property; Said Virgil E. Givens and Katie E. Givens are to each take an undivided one half the right, title, interest and estate hereby conveyed, as tenants in common; Sold and conveyed subject to taxes for the year 1928 and 1929, which second parties assume are to pay: TO HAVE AND TO HOLD The premises aforesaid, with all and singular the rights, privileges, appurtenancs and immunities thereto belonging or in anyway apertaining unto the said parties of the second part, and unto their heirs and assigns FOREVER; the said Myrtle Givens and Effie (Givens) Scott having covenanting that they are lawfully seized of an indefeasible estate in fee in the premises herein conveyed; that they have good right to convey the same; that the said premises are free and clear of any emcumbrances done or suffered by them or those under whom they claim and that they will WARRANT AND DEFEND the title to the said premises unto the said party of the second part and unto their heirs and assigns FOREVER, against the lawful claims and demands of all persons whomsoever. The real estate described here was in Sheridan Township, Daviess Co., Mo. Issac's wife named here was Katie Roseberry Givens. Katie was originally from Sullivan Co., Mo. Katie's Uncle, Robert O. Calhoon (her mother's brother) lived in Daviess Co., Mo. as well. Isaac and Katie met each other when Katie came from Sullivan Co. to visit her Uncle Robert Calhoon.
