One Thousand Nine Hundred by and between Harriet B. Curtis & Frank Curtis, her husband; Merrit Givens & Sarah Givens, his wife; Martha Goodwin & John Goodwin, her husband and Nancy Tolbert, late widow of Merrit Givens, dec'd; Charles W. Creekmore, single & unmarried of the County of Daviess and State of Missouri, parties of the First Part and Daniel P. Doll and Isaac Givens of the County of Daviess and State of Missouri, parties of the Second Part WITNESSETH That the said parties of the First Part in the sum of Two Thousand One hundred Dollars, to them by the said part of the Second Part, the receipt of which is hereby acknowledged do by these presents do Grant, Bargain and Sell, Convey and Confirm unto the said part of the Second Part them of the Second Part, his heirs and assigns, the following described lots, tracts or parcels of land lying, being and situated in the County of Daviess and State of Missouri, to wit: All of the East half of the Southeast quarter of Section Twenty-nine (29) Township (58) Fifty-eight of Range Twenty-eight (28) containing 80 acres more or less This deed is made by all the heirs of Merrit Givens deceased except the grantee Isaac Givens and Sebrina Doll, wife of grantee Daniel P. Doll and Charles Creekmore and his sister Oga ___to convey their interest as such heirs. The said Nancy Tolbert, late widow of Merrit Givens, deceased joins herein for the purpose of conveying all her dower interest in said land and any and all other interest she may have in said land as late widow of the said Merrit Givens deceased. A passageway fifteen feet wide along the west line of said land of above described is hereby granted John Goodwin as long as he owns land adjoining above land or as long as same is used by him but to no one else & no longer to him than is necessary for him to get to public road. TO HAVE AND TO HOLD the premises aforesaid, with all and singular the rights, privileges, appurtenances and immunities thereto in belonging or anywise, apertaining unto the said parties of the Second Part, and unto their heirs and assigns, Forever; the said Grantors hereby covenanting that they are lawfully seized of an indefeasible Estate in Fee in the premises herein by them or those under whom they claim and that they will Warrant and Defend the title to the said premises unto the said party of the Second Part, and unto his heirs and assigns, forever against the lawful claims and demands of all persons whomever. Creekmore, single and unmarried; Nancy Tolbert, single and unmarried to be known to be the persons described in and who executed the foregoing instrument, and acknowledged that they executed the same as their free act and deed. And the said Charles W. Creekmore and Nancy Tolbert further declare themselves to be single and unmarried. Clingan Recorder Additional Comments: This deed is found in Daviess Co., Mo. Deed Book 80, p. 508. Charles W. Creekmore named in deed was son of Eliza Givens Creekmore, dau. of Merrit and Nancy Givens; Eliza at the time of the deed was already deceased, and thus Charles was an heir as a grandson. Heirs also as named in deed were all the living children: Harriet Curtis, Sebrina Doll, Merrit Givens, Jr., Martha Goodwin, Isaac Givens. There were also several children not named here of Nancy and Merrit that had already died young with no living descendents: Richard, Daniel, John, Nancy, William, and Mary Ellen. Thus they are not named in the deed as heirs.
