VALLEE, John, Mary Ann John & Mary Ann Vallée to Patrick Daly, 8 May 1867, 114 acres in Franklin County page 479 [in the margin:] I hereby acknowledge satisfaction in full of the written deed of Trust Witness my hand and seal this 11th day of April A.D. 1873 Attest Michael Bauer Recorder [signed] Michael Bauer This Deed, made and entered into this 8th day of May A.D. 1867 by and between John Vallee and Mary Ann Vallee his wife of the page 480 County of Franklin and State of Missouri parties of the first part and Patrick Daly Party of the second part and Michael Bauer of the County of Franklin in the State aforesaid party of the third part: Witnesseth: That the said party of the first part in consideration of the debt and trust hereinafter mentioned and created, and of the sum of one dollar to them paid by the said party of the second part, the receipt of which is hereby acknowledged, I do by these presents grant, bargain and sell unto the said party of the second part, a piece or tract of land situate in the County of Franklin in the State of Missouri, and described as follows, to wit: The North East qr. of the North East quarter of Section twenty two (22) and the South East qr. of the South East qr. and the North East qr. of the South East qr. of section fifteen (15) all in Township Forty Four (44) of Range three (3) West, except three acres reserved in the North East corner and three acres in the North West corner of the last described tract of land. To have and to hold the same, together with the appurtenances, to the said party of the second part, and to his heirs and assigns forever. In trust, however, for the following purposes: Whereas the said John Vallee has this day made executed and delivered unto the said MichaelBauer his promissory note in words and figures as follows to wit $2,500 00/100 Three months after date I promise to pay to Michael Bauer or his order the sum of twenty five hundred Dollars, for value received negotiable and payable without ? defalcation or discount, bearing ten per cent interest per annum from date until paid. Given under my hand this 8th day of May 1867 - (signed by) John Vallee Now if the said Note shall be well and truly paid, according to the tenor and effect of said note, with all the interest that may be due thereon when said note shall become due and payable, according to the tenor and effect thereof, then this deed shall be void and the property herein before conveyed shall be released all the expenses of the said John Vallee, otherwise the same shall remain in full force and virtue in law and the said Patrick Daly may proceed to sell the property herein before described , or so much thereof as may be necessary to pay the amount specified in said note, with interest and costs of this trust, at public vendue, for cash, at or near the post office in New Haven in the County of Franklin, first giving twenty days notice of the time, terms and place of sale and of the property to be sold, by advertisement in some newspaper published in the County of Franklin in the State of Missouri, and upon the sale and the payment of the purchase money, shall execute and deliver a deed to the property sold to the purchaser, and any statement of fact or recital by the said trustee, in relation to the nonpayment of the money secured to be paid the advertisement, sale, receipt of money and the executions of the deed to the purchaser, shall be received as prima facia evidence of such facts, and the said trustee shall out of the proceeds of such sale pay first the cost and expenses of that trust, and next whatever may be in arrear and unpaid on the note aforesaid, and the balance if any shall be paid to the said John Vallee or his legal representatives. And the said Patrick Daly, trustee as aforesaid, covenants to and with the said John Vallee and Michael Bauer severally faithfully to perform and fulfill the trust herein created. In witness whereof we the said parties have hereunto subscribed our names and affixed our seal this 8th day of May A.D. eighteen hundred and sixty seven. Be it remembered, that John Vallée and Mary Ann Vallee his wife, who are personally known to the undersigned a Justice of the Peace within and for said County to be the persons whose names are subscribed to the within or foregoing deed as parties thereto, this day appeared before me and acknowledged that they executed and delivered the same as their voluntary act and deed, for the uses and purposes therein contained; And the said Mary Ann being by me made acquainted with the contents of said deed, acknowledged on an examination apart from her said husband that she executed the same and relinquished her dower in the real estate therein mentioned, freely and without compulsion or undue influence of her said husband.
