Persons or organizations desiring to use this material for profit or any form of presentation, must obtain the written consent of the files submitter, or their legal representative, and contact the listed USGenWeb archivist with proof of this consent. ***** file submitted by: Curtis Pierce ******************************************************************** Daniel Pearce Last Will and Testament I Daniel Pearce do make publick this my Last Will and Testament hereby resolving and making void all other wills by me made. 1) I advise that my funeral expenses and my debts be paid out of any money which I may die posesed of or which may first come to the hands of my executor here in after named. 2) I give and bequeath to my two sons Wiley and Robert Pearce all my land lying in Gentry County in the state of Missouri and direct that my executor sell paid land and convey the same either at public or private sale and apply the proceeds to the education support and maintanance of my sons aforesaid and I direct that my executor take into her posesion all my personal property of every kind and discription and apply it in any way she may think best for the education and support of my said children, she being my sister and I having the utmost confidence in her that she will do what is best for my children. I furthur direct that whatever of my Estate may be remaining after my two said children arrive at the age of twenty-one be equally divided between them by my said executor and I also direct that my executor shall not be required to give any security for this execution of this my Last Will and Testament. I hereby ordain and appoint Mary Ann McCasland my executor of this Will signed sealed and delivered in the presence of James Pearce and George Bridges. September 3rd day 1858 Daniel Pearce
