Thomas Horn Plaintiff vs trespass assault and battery John Roberts Defendant This day came the parties by their attorneys and upon motion of said Defendant by his attorney to withdraw the plea of not guilty which motion being argued and by the Court duly understood - leave is given him to withdraw his said plea - and the Jurors in this cause sworn and empanelled on yesterday after having heard the evidence and the argument of Counsel upon their oaths say "we of the Jury find the Defendant upon the issue of Justification." Therefore it is considered by the Court here that the said Defendant, John Roberts, recover against the said Plaintiff, Thomas Horn, his costs and charges by him in this defence laid out and expended and that he have thereof execution.
