Mrs. Jane Cathey State of Missouri} County of Henry } On this 15th day of November A.D. 1862, personally appeared before me, Wm Parks Clerk of the Henry County Court – Mrs. Jane Cathey a resident of (Bates Co. crossed out) in the county of Henry and State of Missouri aged 72 years, who being first duly sworn according to law, doth on her oath make the following declaration, in order to obtain the benefit of the provision made by the ACT OF CONGRESS approved July 14, 1862: That she is the widow of David Cathey, who was a Private in Company “A” commanded by Capt. Smith in the 2nd Battalion Missouri State Militia in the War of 1861, who died on the 28th day of October at the Hospital in Sedalia Missouri. She further declares that she was married to the said David Cathey on the 16th day of October in the year 1853; that her husband, the aforesaid David Cathey died on the day above mentioned, and that she has remained a widow ever since that period, & has the following children by said deceased to wit: James H. born 4th Feby. 1856. George M born 15 August 1857. John D. born 14th May 1859. Paralee born 14th Oct. 1861. As will more fully appear by reference to the proof hereto annexed. She also declares that she has not in any manner been engaged in, or abetted, the rebellion in the United States. Jane Cathey Also personally appeared Mrs. Catherine Long and Mrs. Jane Long residents of Henry County MO, persons whom I certify to be respectable and entitled to credit, and who, being by me duly sworn, say that they were present and saw Jane Cathey sign her name to the forgoing declaration; and that they further swear that they have every reason to believe, from the appearance of the applicant and their acquaintance with her, that she is the identical person she represents herself to be, and that they have no interest in the prosecution of this claim. It appears from the Rolls on file in this office that David Cathey was enrolled on the 26th day of February, 1862, at Harrisonville Mo. In Co. “A” 2nd Battalion of Missouri Mil. Volunteers, to serve three years, or during the war, and mustered into service as a prvt. On the 17th day of March, 1862, at Harrison Mo in Co. “A” 2nd Battalion of Missouri Mil. Volunteers, to serve three years, or during the war. On the Muster out Roll of Co. A of that Battalion dated March 31st 1863, he is reported “Died of disease at Sedalia Oct. 30/62”. [I’ve included the following to help explain why this family may have had to move their homes, most of Bates County being evacuated by the military authorities, and continued filing in the jurisdictions of the probably safer Henry County.] General Order #11-8/25/1863- Signed by Union Brigadier General Thomas Ewing, Jr. First: All persons living in Cass, Jackson, and Bates counties, and in that part of Vernon county within the District, with the exception of those residing within one mile of Union-held towns and except those in that part of Kaw Township, Jackson county, north of Brush Creek and west of the Big Blue River, embracing Kansas City and Westport, are hereby ordered to move from their present places of residence within 15 days. Those who within that time establish their loyalty to the satisfaction of the commanding officer of the military station nearest their present place of residence, will received from him certificates stating that facts of their loyalty and the names by whom it can be shown. All who receive such certificates will be permitted to remove to any military station in this district or to any part of the state of Kansas, except all the counties on the eastern border of the state. All others shall remain out of the district Second: all grain or hay in the fields or under shelter in the District from which the inhabitants are required to move within reach of military stations, after the ninth of September will be taken to such stations and turned over to the proper officers there; and report of the amount so turned over made to the district headquarters specifying the names of all loyal owners and the amount of such produce taken from them. All grain and hay found in such district after the ninth of September next, not removed to such stations will be destroyed. State of Missouri} County of Henry } Be it remembered that on this 5th day of January 1864, before the undersigned Clerk of the County Court in and for the county aforesaid personally appeared Mrs. Jane Cathey who being by me first duly sworn according to law, upon her oath states, That she is the widow of David Cathey, Company “A” Capt. Smith 2nd Batt. M. S. M. commanded by Nugent. That her said husband David Cathey died at Sedalia Missouri on the 28th day of October 1862, and that she is the identical person who made application for pension and her application is numbered 6,757. That her Post Office is Clinton in the county of Henry and State of Missouri. That she has one child named James Henry, born on the 4 day of February 1856. And one child named George Monroe born on the 15 day of August 1857. And one child named John David born on the 14 day of May 1859. And one child named Paralee born on the 13th day of October 1861. Additional Proof case Jane Cathey no. 6757 State of Missouri} County of Henry } On this 29th day of February. 1864, personally appeared before me, the Clerk of the County Court within and for said county, Mrs. Jane Cathey a resident of the county of Henry and State of Missouri and her Post Office is Clinton Henry County aged 30 years, who being first duly sworn according to law, doth on her oath make the following declaration, in order to obtain the benefit of the provision made by the ACT OF CONGRESS approved July 14, 1862: That she is the widow of David Cathey deceased, who was a Private in Company “A” commanded by Capt. Smith in the 2nd Battalion of Missouri State Militia commanded by Col. Newgent in the War of 1861, who died at Sedalia (Hospital) in the State of Missouri on the 28th day of October A.D 1862 in consequence of disease called pneumonia (and was sick with said disease about two weeks before his decease,) contracted in the service of the United States. She further declares that she was married to the said David Cathey on the 16th day of October in the year 1853 in the County of Cass and State of Missouri, that her husband, the aforesaid David Cathey died on the day above mentioned, and that she has remained a widow ever since that period, and has children of the following names and ages by said deceased to wit: James H, born on the 4 day of February 1856. George M born on the 15 August 1857. John D. born on the 14 day of May 1859. Paralee born on the 14th October 1861. As will more fully appear by reference to the proof hereto annexed. FIELD, esq., of St. Louis, Missouri, my true and lawful attorney, in fact, for me, and in my name, place and stead to prosecute my said claim for pension, and to receive the certificate therefore, and to that end to do all and singular such acts and things as may be necessary. They further state that said applicant and deceased lived and cohabited together as man and wife for ten or twelve years and as such were the parents of the children as set forth above. That they were for twelve years personally well acquainted with the applicant and deceased. That affiants were present and saw applicant & deceased married. That the records of Cass County Mo have been destroyed. It is impossible to get any marriage record from Cass County. All have been burned by the parties raiding in that county. These facts I know because I was a practicing lawyer in that Co., for many years. I hope all is now full except for surgeon’s certif. & this we cannot get as the battalion long since has been dissolved & broken up & we can’t find out where any of the officers are & must rely upon the records in the Adjutant General’s office. Yours truly W.S. Field I certify that I was Assistant Surgeon of the 2nd Battalion Cav. M.S.M. commanded by Col. Newgent, up to the 27th day of September 1862 at which time I was transferred to the 6th Cav. M.S.M.; and placed in charge of the Post Hospital at Sedalia on the 29th day of the named month and year. I furthermore certify that David Cathey of Company A. 2nd Batt. Cav. M.S.M. was in the battle of Lone Jack, Jackson County Missouri on the 16th Day of August 1862 and received one or two wounds. One was on the chest, (the extent of which I do not now recollect as I have lost part of my notes). At the time of his death on or about the 28th of October 1862 he was laboring under “Chronic Diarrhea,” which disease in my opinion was contracted in consequence of the wounds that the said Soldier received in the above battle, while in the line of his duty, gallantly defending his country. When I say that the said disease above mentioned was caused by the wounds received, I intend to include all the exposure of fatigue and so on incident to the battle. Therefore I hesitate not in saying that his disease was contracted after his enlistment. I would further certify that the said David Cathey was under my treatment in the hospital at Sedalia Missouri at the time of his death. W.H.H. Cundiff Assistant Surgeon 6th Cav. Perhaps because she had removed at that time to California? There she seems to have met John Ontis, whom she married July 1866, although I still cannot find which county this occurred in. in 1883 she tried to renew and claim benefits owed her.
