LAND DEEDS - VOLUME Z, PAGE 381 Know all men by these presents that I Joshua Newbrough of the County of Frederick and state of Virginia for and in consideration of the love & affection, I bear to Benjamin DeHaven of the County Of Howard and state of Missouri, Have given and granted and by these presents do give, grant and confirm unto him the said Benjamin DeHaven and his heirs forever, twenty acres of land, situate, lying and being in the County of Howard and state of aforesaid is being off the south end of the east half of the south west quarter of section tenty three in township no. 49 of range no. 15. to have and to hold the said land with all the appurtenances thereunto belonging, or in any wise appurtenaning unto the said Benjamin DeHaven and heirs and assigns forever free from the claims of any person or persons claiming by, through as under me. White State of Missouri County of Boone Appenouge: If there should be any of the cleared land on the above described tract of land, David White and Sarah his wife is to hold and use the said land during their lifetime or (illegible), the said DeHaven shall clear as much land as the said White may designate, and no more than shall be found on said twenty acreas. White Be it remembered that on the twenty third day of September in the year of our Lord One Thousand Eighteen Hundred and Thirty Six, personally came before me the (?) onsigned clerk of the Boone Circuit Court, John M. Kellywho is personally known to me to be the person whose name is subscribed to the wit(?) and foregoing deed or instrument of writing and made oath that Jodhua Newbrough whose name is subscribed to the said instrument of writing as grantor is the real person who executed the same, that the said Joshua Newbrough subscribed, sealed and delivered the same in his presence and acknowleged the same to be his act and deed for the purposes therin mentioned, and that he the John M. Kelly subscribed to the said deed as a witness in the presence and at the request of the said Joshua Newbrough. John M. Cooker recorder Know all men presents that said Benjamin Dehaven and Mary Dehaven his wife of the county of Howard and state of Missouri for and in consideration of the sum of forty dollars to us in hand paid by Joshua F. White, the receipt of which is hereby acknowledged, have this day granted, bargained and sold and by these presents do grant, bargain and sell unto the said Joshua F. White and his heirs, of the county and state aforesaid forever twenty acres of land, situate, lying and being in the County of Howard and state of Missouri, it being off the south end of the east half of the south west quarter of section twenty three in township no 49 of range no 15. to have to hold the said land with all the appurtenances thereunto belonging as in any wise appertaining unto the said Joshua F. White and his heirs and assigns forever free from the claims of any person or persons claiming by or through as under me. In testimony whereof we hereunto set our hand and affix our seals this fifth day of March a.d. 1850 Benjamin Dehaven (seal) Mary X Dehaven (seal) State of Missouri County of Howard Be it remembered that on this 5th day of March in the year of our Lord one thousand eight hundred and fifty - personally came before me the undersigned and under the Justices of Peace within and for the County of Howard, Benjamin Dehaven and Mary Dehaven his wife both personally known to me to be the persons whose names and subscribeth to the foregoing instrument of writing as parties thereto & acknowledged the said instrument to be their act and deed for the purposes therein mentioned, she the said Mary Dehaven being by me made first acquainted with the contents thereof and examend separate and apart from her said husband whether she executed the said deed & relinquishes her dower voluntarily, freely & without compulsion or undue influence of her said husband & relinquishes her dower in the said land & tenements therein mentioned.
