Term 1851 - Petition for Injunction James M. Brown, John M. Brown and Nancy A. Brown, Clementina D. Brown & Simeon Anderson Brown by their next friend John M. Brown, Pltfs. vs. Garland A. Brown, Deft. Now at this day comes said plaintiffs by their attorney and the defendant although duly served with process and solemnly called comes not but makes default, thereupon said plaintiffs submit this cause to the court. And the court doth find from said petition, exhibits and evidence adduced herein that said plaintiffs are entitled to a certain Negro girl named Harriet as their own property after the determination of the use of said Negro, which said defendant may be entitled to during his life, and it further appearing to the Court that there is great danger of said Garland A. Brown selling and conveying said Negro girl Harriet to the great prejudice and irreparable injury of the said plaintiffs. It is therefore ordered, adjudged and decreed that the said Garland A. Brown be enjoined, restrained and inhibited from selling said Negro and from removing or conveying her out of the county of Lewis in the State of Missouri. It is further ordered that unless said defendant be and appear in this court and shew cause why this decree ni si should be set aside the same will be made final and absolute. And on motion of plaintiffs it is ordered that the sheriff of said county of Lewis take bond of said defendant in double the value of said Negro for her delivery to him at the aforesaid next term of this court until which time this cause is continued. page 92 - May Term A.D. 1852 - Injunction James M. Now at this day comes said plaintiffs by their attorney and the defendant although duly served with process and solemnly called comes not nor has he in any wise shown cause for setting aside the Decree ni si rendered herein against him at the last term of this Court. It is therefore ordered adjudged and decreed by the court that the said decree ni si rendered herein at the last term of Court be and the same is hereby made final and absolute.
