Mallory to Browns Deed This Indenture made & Entered into this 4th Day of February 1852 between Elias Mallory & Rexaline Mallory his wife of the first part & Garland Brown & Thomas Brown, Willis G. Brown, John M. Brown of the Second part all of the county of Lewis & State of Missouri. Witnesseth the part of the first part have this Day bargained Sold & Do by these presents grant bargain Sell & convey All the right title & Interest in the following Real Estate Lying & being in the County of Lewis & Known & designated as follows: the North East Quarter of the North East Quarter of Section thirteen Township Sixty Range Seven, part of the North West Quarter of the North West Quarter of Section Eighteen Township Sixty Range Six it being on the West Side of the Fabius River to include to the middle of the main channel of said Stream, also a part of the South West Quarters of Section Section [sic] Seven lying on the East side of said Stream, containing ninety Acres be the same more or less for & in consideration of the Sum of Three Hundred & twenty Dollars to them in hand paid the receipt whereof is hereby acknowledged by the party of the first part. Now the party of the first part for themselves their heirs Executors or Administrators do covenant with Garland Brown & Hannah Brown his wife To Have and to Hold Said Real Estate during their natural lives with all & Singular the rights privileges appurtenances thereunto belonging or appertaining thereto after the decease of the Said Garland Brown & Hannah his wife after the decease the said John M. Brown is to hold the one fifth part of Said Real Estate & Willis G. Brown is to have & to Hold four fifths of Said Real Estate after their fathers & mothers decease, with all the rights privileges appurtenances thereunto belonging or appertaining thereto. Now the party of the first part do agree to warrant & defend the right title against the claim or claims of all persons Except them as specified in Said Deed. In testimony we have here Set our hands & affixed our Seals the day & year aforesaid. Elias M. Mallory (Seal) Roxaline Mallory (Seal) State of Missouri County of Lewis On this 4th Day of February 1852 personally appeared before me Elias Mallory & Roxaline Mallory his wife both personally known to the undersigned a Justice of the peace within & for Said County of Lewis to be the persons whose names are Subscribed to the within deed as parties thereto this day appeared before me & acknowledged that they Executed & Delivered the Same as their voluntary act & Deed for the uses & purposes therein contained & the said Roxaline being by me made acquainted with the contents of Said Deed acknowledged on an Examination apart from her husband that she Executed the Same & relinquishes her Dower in the real Estate therein contained freely & without compulsion or undue influence of her Said husband.
